Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #22-056 RESOLUTION APPPROVING ASSESSMENT AGREEMENTS FOR IMPROVEMENT PROJECT #20-05, RIVERDALE DRIVE EXTENSION, LLAMA STREET TO BOWERS DRIVE WHEREAS, existing Riverdale Drive between Sunfish Lake Boulevard and Armstrong Boulevard functions as the south frontage road to U.S. Highway 10/169; and WHEREAS, the City of Ramsey proposes to extend Riverdale Drive, as well as trunk sanitary sewer and watermain since this area is zoned as MUSA, between Llama Street and Bowers Drive to extend the south frontage road system south of U.S. Highway 10/169 to Bowers Drive; and WHEREAS, this improvement project is consistent with the goals and objectives of the Highway 10 Access Planning Study completed in 2014 in partnership between the Minnesota Department of Transportation (MnDOT) and the Anoka County Highway Department, and broadly supported by partnering agencies including the City of Anoka, City of Ramsey, Anoka County, MnDOT, and the Metropolitan Council; and WHEREAS, extending Riverdale Drive and municipal trunk utilities between Llama Street and Bowers Drive will benefit abutting undeveloped properties by providing access and utilities to serve these properties upon development; and WHEREAS, pursuant to Ramsey City Council Resolution #21-185 adopted October 26, 2021, the City Council approved the cost share framework assigning costs for the Riverdale Drive extension to benefiting properties, including the properties owned by various members of the Pearson family comprising three distinct ownership entities; and WHEREAS, the City prepared three draft Assessment Agreements, one for each distinct ownership entity, which were reviewed and approved as to form by the City Attorney; and WHEREAS, the three draft Assessment Agreements are currently being reviewed by the three ownership entities and their attorneys and are anticipated to be signed and returned to the City for execution by March 14, 2022; and WHEREAS, pursuant to Ramsey City Council Resolution #22-008 adopted January 25, 2021, the City Council approved the Development Agreement for Riverstone South contingent on condition #6 that required execution of the Pearson's Assessment Agreements for Riverdale Drive be recorded concurrently with the Development Agreement and/or Riverstone South Final Plat; and WHEREAS, the Riverstone South developer desires to record their Development
