Council member XXXX introduced the following resolution and moved for its adoptic~n: <br /> <br />RESOLUTION/t05-09- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0 RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT FROM GEORGE AND FRANCES <br />COWLES TO CONSTRUCT AN ACCESSORY STRUCTURE FOR A LEGAL, NON- <br />CONFORMING RESIDENCE AT 9537 HIGHWAY 10 NW. <br /> <br /> WHEREAS, George and Frances Cowles, hereinafter referred to as the "Applicant," <br />have properly applied ibr a Conditional Use Permit to construct an accessory structure to a legal, <br />nonconibrming residence, on the property generally known as 9537 Highway 10 and legally <br />described as ~bllows: <br /> <br />l.ot 2, Block 1, COWLES ADDITION <br /> ("Subject Property") <br /> <br />NOW TflEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That the Applicants appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.14 of the Ramsey City Code on September 1, 2005, and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated by reference. <br /> <br />2. That thc Subject Property is zoned B-2 Business. <br /> <br />3. That the Subject Property is approximately 1 acre in size. <br /> <br />4. That the Subject Property contains a residential dwelling that has been documented by the <br /> City of Ramsey in a letter dated December 27, 1991 to be a legal, non-conforming use. <br /> <br />That the Applicant would like to construct a garage as an accessory use to the residence on <br />the Subject Property. <br /> <br />That City Code restricts legal, non-conforming uses from expanding Unless by issuance of an <br />appropriate permit. <br /> <br />That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use or to the public welfare. <br /> <br />That the proposed use will not substantially adVersely impair the Use, enjoyment, or market <br />value of any surrounding property. <br /> <br />9.
