Motion by Commissioner Johnson, seconded by Chairperson Nixt to recommend that the City <br />Council grant approval of the proposed site plan contingent upon the compliance with City Staff <br />Review l,cttcr dated August 2, 2005. <br /> <br />(iommissioner Van Scoy asked if the questions about run-offhave been addressed. <br /> <br />City l:,ngineer Jankowski stated that the applicant has been asked to re-configure the plans. He <br />indicated this is a TIF project, and he is expecting that the TIF portion will fund the necessary <br />drainage. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Levine, Shepherd, and <br />Van Scoy. Voting No: None. Absent: Commissioners Brauer and Watson. <br /> <br />Case #7 <br /> <br />Public Hearing - Request to Renew a Conditional Use Permit for an Asphalt <br />Production Plant; Case of Commercial Asphalt <br /> <br />I'resentation <br /> <br />Assistant Community Development Director Frolik advised that since July 12, 1988, <br />(;ommercial Asphalt has been operating under a CUP issued by the City. The most recent pmxnit <br />expired on Marcy 15, 2005. She stated that Commercial Asphalt has submitted another request <br />to renew their Conditional Use Permit. <br /> <br />Assistant Community Development Director Frolik explained that during the past 5 year term of <br />thc permit, City Staff did receive complaints regarding odorous emissions from the plant. She <br />indicated that these complaints were generated by a resident living near the plan. She stated that <br />thc City Public Works staff monitored the odors daily, and in each case the applicant made every <br />cflbrt to address the issue. She noted that no complaints have been received during the 2005 <br />SC/_ISOI]. <br /> <br />Assistant Community Development Director Frolik further advised that the applicants are <br />proposing to install some site improvements on the property, including paving the product <br />production and loading area, truck lanes, and customer and employee parking areas. She stated <br />that thc outer perimeter of the pavement parallel to 141st Avenue and along their east property <br />line is proposed to be finished with concrete curbing, however the interior edges of the <br />bituminous are not proposed to be curbed. She indicated the applicants have stated that the <br />curbing of interior edges of bituminous would hamper stockpiling and truck maneuvering <br />activity. <br /> <br />Assistant Community Development Director Frolik stated that every attempt has been made to <br />comply with the City Code requirement for 20 feet of greenspace adjacent to public roads. <br />l lt~wevcr, existing plant structures would prohibit compliance with this requirement on the <br />northeast corner of the. site. She stated that Staff is recommending approval of the Grading, <br />Drainage, and Paving Plan and the Landscaping Plan as proposed. <br /> <br />Planning Commission/August 8, 2005 <br /> Page 18 of 26 <br /> <br /> <br />
