Mr. Kemp asked if the application asks for the what kind of a business you will have. <br /> Councilmember Heineman stated he believed so. <br /> Mr. Kemp replied it doesn't seem like you have to because it is a residential area. He stated he <br /> worked at a body shop and he has been asked to do that out of his home but he didn't think he <br /> could get a permit. He stated it isn't a good fit for the neighborhood because there is one way in <br /> and one way out and people wouldn't be there if they didn't live there. <br /> Councilmember Heineman replied that if Mr. Kemp applied for a permit to paint cars as a small <br /> business, he would support it. <br /> Mr. Kemp replied the City has said you can't do car repair commercially. He didn't think there <br /> was a permit for that and it could only be done in an area that is zoned commercial. <br /> Councilmember Heineman replied if a need was identified and it was within the parameters, he <br /> would support it. He stated a paint shop would include combustible materials that would be <br /> dangerous to the neighborhood but if it was proven that precautions were taken he would support <br /> it. <br /> Councilmember Howell asked if it was correct that steps are being taken regarding the violations <br /> which include either going back to the level one HOP or going to the level two HOP. <br /> City Administrator Ulrich replied that is was a result of an enforcement action to enforce the <br /> original HOP. <br /> Councilmember Howell replied they are taking steps to address the residents' concerns but it isn't <br /> appropriate to move someone from a first violation to abatement;the process needs to be followed. <br /> Female resident (name not stated) commented that enforcement is being talked about and the <br /> Police Chief is going to come out to look at it, but after that, how often are gun shops being <br /> monitored. She asked who is going to monitor Mr. Trout. She stated he has already violated his <br /> permit and none of them have been addressed until neighbors called to complain because no one <br /> monitored his gun business. <br /> Councilmember Specht stated he appreciated the feedback from the Council and residents and that <br /> he is taking a bigger picture and if this business would be singled out. <br /> Motion by Councilmember Specht, seconded by Councilmember Heineman, to amend the <br /> language of Resolution #22-041 to approve the amendment to a Home Occupation Permit Level <br /> Two at 6025 177th Lane NW with the condition that it would be by appointment only and that the <br /> Police Chief would review the facility. <br /> Further Discussion: <br /> Councilmember Howell asked if the Police Chief would want to make any annual visits or work <br /> out a process with Staff to monitor the business in addition to the original inspection. <br /> City Council/March 8, 2022 <br /> Page 22 of 38 <br />
