He has extensive <br /> experience in ammunition with firearms and firearm safety with students of all ages. <br /> Councilmember Heineman explained for the audience that Mr. Trout's experience covers <br /> everything from a handgun to an antitank rocket launcher, including machine guns. <br /> Councilmember Riley stated Mr. Trout is very clearly experienced and certified but asked about <br /> the retail out of his home. <br /> Mr. Trout replied according to the last Planning Commission meeting, retail is legal in residential <br /> neighborhoods. He stated the request for round trips per day is the amount of a level 2 permit. He <br /> stated the retail is for firearms which would have to be an in-person transfer who would go through <br /> a background check through the FBI system, and to make sure they have a permit to carry. He <br /> stated he would like to be able to offer additional holsters, optics, accessories and multiple firearm <br /> purchases. He stated he isn't asking to have open hours or signage but is looking for appointments <br /> only which would allow him to do a screening and background check. He stated the majority of <br /> people he has sold to in the past have been friends, family and a variety of public servants. He <br /> stated his clients have been repeat customers who he knows and trusts. <br /> Mayor Kuzma asked if people are buying a firearm if they are picking it up from his house. <br /> Mr. Trout replied they are required to pick it up from a licensed dealer or he ships firearms to <br /> another dealer across the country. In that case, they ensure the dealer is legal to have the firearms <br /> before shipping. <br /> Councilmember Woestehoff stated Mr. Trout is very detail oriented in his certifications and <br /> expertise and signed off on the permit with strict conditions but Staff was notified of this because <br /> of violations of the permit and asked if Mr. Trout forgot about conditions and because of it is being <br /> escalated to a level two permit. <br /> Deputy City Administrator/Community Dev. Director Hagen replied Councilmember Woestehoff <br /> was correct that concerns were raised about the activities and asked if something against ordinance <br /> was occurring. Staff found there was an existing home occupation permit, looking at it expanding <br /> it to an accessory structure which is a move away from just online sales. Staff determined Mr. <br /> Trout was in violation and sent a letter and suggested applying for an amended home occupation <br /> permit. He stated if the request were denied it would be Staff s recommendation to allow Mr. <br /> Trout to correct his operations under the existing permit. If he choses not to, it would potentially <br /> go down the revocation path. <br /> Councilmember Riley asked what the number of trips that are allowed and how that compares to <br /> other home occupation permits that are allowed. <br /> Deputy City Administrator/Community Dev. Director Hagen replied that because it is a permit <br /> there can special conditions placed on it to restrict the impact of the neighborhood such as number <br /> of trips per day,number of classes per year or attendees and parking restrictions.
