that the current Indemnification A~eement be amended to allow tbr one additional building to <br />be constructed. <br /> <br />Community Developrnent Director Trudgeon advised staff feels this is a reasonable request <br />~ven the strong desire to see additional construction commence in Ramsey Town Center. The <br />Indemnification Agreement, reviewed by the City Attorney, provides protection to the City in the <br />event of problems with the location of the building. Staff recommends that the Indemnification <br />Agreement be amended to allow for one additional building to be constructed pr/or to the <br />recording of the final plat. <br /> <br />Councilmember Olson asked how many units would be constructed. <br /> <br />Community Development Director Trudgeon replied four units would be constructed. <br /> <br />Motion by Councilmember Olson, seconded by Councilmember Jeffrey, to enter into an <br />Indemnification Agreement allowing for one additional building to be constructed prior to the <br />recording of the final plat for the Ramsey Town Center 9th Addition. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councihnembers Olson, Jeffrey, Cook, Pearson, <br />and Strommen. Voting No: None. Absent: Councilmember Elvig. <br /> <br />Councilmember Elvig returned to the meeting at 8:50 p.m. <br /> <br />Case #11: Authorize Acquisition of 14230 Basalt St NW <br /> <br />City Attorney Goodrich explained staff has been directed by the EDA to facilitate development <br />and redevelopment activity and to acquire properties in the City's Development District No. 1 as <br />willing sellers put their properties on the market.. Staff has obtained an appraisal and has <br />presented an offer of $3 t 5,000, which includes relocation for the property. Staff feels that the <br />acquisition of this property is consistent with the development program of TIF District No. 2 and <br />will promote high quality development on the site. The intention of the City is to relocate Dave <br />Perkins Contracting to 7060 143rd Avenue NW where this business will construct a new <br />building. Staff is requesting that'the City Council authorize the acquisition of this parcel and to <br />execute the documents necessary to transfer the property into City ownership. <br /> <br />Councilmember Elvig questioned the $31.5,000 relocation costs, as his understanding is. that <br />relocation costs apply when there is a taking of property as opposed to the property being on the <br />open market. <br /> <br />City Attorney Goodrich replied just about anything the City purchases, whether or not it is <br />through the open market, includes relocation obligations. <br /> <br />Motion by Councilmember Cook, seconded by Councihnember Jeffrey, to authorlze execution of <br />a purchase agreement and related documents to complete the acquisition of 14230 Basalt St NW <br />contingent on City Attorney approval. <br /> <br />P64 <br /> <br />City Council / September 13, 2005 <br /> Page 20 of 33 <br /> <br /> <br />
