Case #9:

Adoption of Ordinance Amending the 2005 Schedule of Rates, Fees, and
Charges Regarding Sewer and Water Trunk Fees for Plats recorded in 2004

Counci hnember Elvig left the meeting at 8:47 p.m.

Community Development Director Trudgeon reviewed that on January 25, 2005, the Council
adopted an ordinance that amended the 2005 Schedule of Rates, Fees, and Charges to provide
that all lots within plats recorded with Anoka County in 2004 be charged the 2004 Sewer and
Water Trunk Fee rate. The 2005 water and sewer trunk fees were raised significantly as a result
o~' the completed Sewer and Water Comprehensive Plan. He explained an error occurred within
the proposed ordinance that listed the 2005 sewer and water trunk rates instead of the 2004 rates.
The adopted ordinance had the sewer trunk fee as $1,100 per unit instead of $596, and the water
trunk l[:c was listed as $1,862 per unit instead of $1,327. The lower amount should have been
inserted into the ordinance. He advised the Council introduced the proposed ordinance on
August 23, 2005. The ordinance is now eligible for adoption.

Motion by Councilmember Pearson seconded by Councilmember Strommen, to adopt Ordinance
#05-23 to amend the 2005 Schedule of Rates, Fees, and Charges in order to collect sewer and
watcr trunk hook-up charges at the 2004 rate for plats recorded in 2004.

A roll call vote was perfonned by the Recording Secretary:

Mayor Garnet: aye
Councihnember Cook: aye
Counci hncmber Elvig: absent
Councihnembcr Jeffrey: aye
Councilmcmber Olson: aye
Councilmember Pearson: aye
Councihnember Strommen: aye

Motion carried.

Case # ! 0:

Request for Amendment to Indemnification Agreement between City of
Ramsey, Ramsey Town Center, and Alan Chazin Homes Pertaining to the
Ramsey Town Center 9th Addition

Community Development Director Trudgeon reviewed that the City Council approved the final
plat fi)r Ramsey Town Center 9th Addition. During that meeting, the City Council also agreed to
enter into an indemnification agreement with the Ramsey Town Center, LLC and Alan Chazin
Homes that would allow for the start of one townhouse building prior to the final plat being
recorded. Alan Chazin Homes and Ramsey Town Center LLC is asking for an amendment to
allow for one additional building to be constructed prior to the final plat being recorded. He
explained the final plat of Ramsey Town Center 9th Addition is currently at the Anoka County
Surveyors Office for plat checking. With the backing of plats at Anoka 'County, it is expected to
bc about one month until the plat will be ready to be recorded. Given that fact, plus the desire to
:~tmt construction of another building before colder weather sets in, Alan Chazin Homes is asking

City Council / September 13, 2005

P63
