City Attorney Goodrich distributed the settlement agreement between the City <br />and the Dusbabek and Kaas properties in relation to 1-60th Lane. He advised as <br />part of' the negotiated settlement, the City agreed to not specially assess either <br />property for any improvements of 160th Lane until those properties develop or <br />subdivide. <br /> <br />Community Development Director_Trudgeon explained there were questions <br />among the property owners over the summer about who can use 160th Lane and <br />who will maintain it. The City originally thougj'~t Mr. Bower would have the <br />ability to utilize the driveway and gave him permission for that. After doing more <br />legwork it was determined that since there is a public right-of-way there is <br />nothing the City can do to prevent anyone from using that right-of-way. Due to <br />thc ongoing disputes among the property owners staff would like to bring this <br />tbrward to the Council to consider whether 160th Lane should be made into a City <br />road so there are no longer disputes. <br /> <br />The consensus of Mr. and'M2-s. Kaas, Mr. Dusbabek and Mr. Bower was that they <br />are not in agreement with 160th Lane being turned into a full City road. <br /> <br />There was considerable discussion with the residents and the Public Works <br />Committee regarding the current use of 160ta Lane and the possibility of <br />improving the road to the status of a public street. <br /> <br />Motion to upgrade 160th Lane to a full width class 5 non-bituminous road to be <br />maintained and cared for by the City. <br /> <br />The motion died for lack of second. <br /> <br />Chairperson Elvig suggested this issue be forwarded to the full Council for <br />discussion. <br /> <br />City Attorney Goodrich recommended a work session agenda item be scheduled <br />for this discussion. <br /> <br />Action: <br /> <br />Motion to bring this item back to City Council as a work session topic in the <br />future. <br /> <br />COMMITTEE/STAFF INPUT <br /> <br />Receive Request from Colleen Fisher for s stop sign for 154th Lane at <br />Marmoset <br /> <br />The City has received a request from a resident for a stop sign at 154th Lane and <br />~[armoset.
