Absent: Commissioners Johnson andLevine. <br /> <br />Case #3 <br /> <br />Request for a Conditional Use Permit to Construct an Accessory Structure <br />for a Legal, Non-Conforming Use; Case of George and Frances Cowles <br /> <br />Presentation <br /> <br />Associate Planner Dalnes advised that this is a request for a conditional use permit to construct <br />an accessory structure for a legal, non-conforming use, located at 9537 Highway 10. She stated <br />the sub. jcct property is approximately 1 acre in size and is zoned B-2 Business District. She <br />indicated the proposal seeks to expand the legal, non-conforming use by constructing a garage as <br />an accessory use to a private residence located on the property. <br /> <br />Public tlcaring <br /> <br />Chairperson Nixt opened the public hearing at 7:30 p.m. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Van Scoy to close the public hearing at <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Van Scoy, Brauer, Shepherd, <br />and Watson. Voting No: None. Absent: Commissioners Johnson and Levine. <br /> <br />Commission Business <br /> <br />Associate Planner Dalnes noted that this property is outside the area designated for future <br />l ti ghway//10 itnprovements. <br /> <br />Chairperson Nixt stated he is in favor of this because it promotes organization of the property. <br /> <br />Ck~airpcrson Nixt asked if this would be one overhead door. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Watson to recommend the City Council <br />adopt Findings of Fact relating to George and Frances Cowles' request for a conditional use <br />pemfit to build an accessory structure for the legal, non-conforming residence on the property at <br />9537 t lighway 10, favorable to the applicant. <br /> <br />Motion carried.
