misdemeanor. <br /> <br />f. <br /> <br />Subd. <br /> <br />Exterior solid fuel-fire',heating devices shall be located at least se,zenty- <br />five (75) feet from any property line and shall not be .located 'in the front <br />yard. <br /> <br />All exterior solid fuel-fired heating devices installed or purchased within <br />the City are required to meet the emission standards currently required (or <br />as may be amended from time to time) by the Environmental Protection <br />Agency (EPA) and Underwriters Laboratories (UL) listing. <br /> <br />All exterior solid fuel-fired heating devices are subject to regulation as <br />public nuisances as described in this Section. <br /> <br />Dense smoke, noxious fumes, gas and soot, or cinders, in unreasonable <br />quantities, are declared a public nuisance and are hereby made subject to <br />regulation and control by a properly desi~onated authority. <br /> <br />All exterior solid fuel-fired heating devices installed within the City shall <br />be listed and labeled by a nationally recognized testing laboratory and <br />installed according to the manufacturer's recommendations. <br /> <br />The following materials shall not be used or burned in exterior solid fuel- <br />fired heating devices: grass, leaves, oils, rubber, plastics, tires, railroad <br />ties, construction debris and painted or chemically treated materials such <br />as treated lumber, composite shingles, tar paper, insulation composition <br />board, sheetrock, wiring, paint and hazardous and industrial solid waste. <br /> <br />Violations. Any violation of this ordinance shall be considered a <br /> <br />SECTION 3. SUMMARY <br /> <br />The following official' summary of Ordinance #05-__ has been approved by the City Council of <br />the City of Ramsey as clearly informing the public of the intent and effect of the Ordinance. <br /> <br />It is the intent and effect of Ordinance #05-__ to amend Ramsey City. Code Chapter 9 (Zoning <br />and Subdivision of Land) to: <br /> · Renumber 9.1 t.14 (Compliance) to 9.11,15. <br /> · 'Establish regulations and ~tidelines for exterior solid fuel-fired heating devices. <br /> <br />SECTION 4. EFFECTIVE DATE <br /> <br />The effective date of this ordinance is thirty (30) days after its passage and publication, subject to <br />City Charter Section 5.07. <br /> <br />Adopted by the Ramsey City Council the day of <br /> <br />,2005. <br /> <br />-288- <br /> <br />Mayor <br /> <br /> <br />
