This summer the League of Minnesota Cities legal counsel issued an <br />opinion that truncated domes must be installed on all pedestrian curb ramps in public right-of- <br />way. Staff is responding as quickly as possible to this opinion. The recommendation of staff <br />and lhc I'ublic Works Committee is that the City Council adopt the new pedestrian curb ramp <br />detail to include truncated domes on all right-of-ways in the City. <br /> <br />Motion by Councihnember Elvig, seconded by Councilmember Olson, to ratify the <br />recommendation of the Public Works Committee in Case No. 4 and to adopt the new pedestrian <br />ct!rb ramp detail as outlined by staff. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Olson, Cook, Jeffrey, <br />I'd:ars(m, and Strommen. Voting No: None. <br /> <br />5) Consider the Improvement on 160th Lane to the Trappers Ridge Subdivision <br /> <br />Councilmcmber Elvig indicated the Public Works Committee recommended this case come to <br />thc full ('ouncil for discussion. <br /> <br />Assistant Public Works Director Olson stated there was significant discussion at the Public <br />Works (~ommittee meeting relative to whether the City should upgrade 160th Lane to the <br />Trappers Ridge Subdivision, and how that upgrade would be paid for. There was consensus by <br />Mt-. and Mrs. Kaas, Mr. Dusbabek and Mr. Bower that they are not in agreement with 160th Lane <br />being turned into a full City road. A motion was made to upgrade 160th Lane to a full width <br />class 5 non-bituminous road to be maintained and cared for by the City; the motion died for lack <br />el' a second. There was further discussion and a recommendation that the case be brought back <br />to; thc t'ull Council, and that it be discussed at a work session in the future. <br /> <br />Councilmcmber Cook stated the difficulty right now is that Mr. Bowers put this road in and is <br />using it Ibr a driveway. Since it is public property other people are using the road to access their <br />back and side yards, and asking Mr. Bowers to maintain the road. <br /> <br />Assistant l'ublic Works Director Olson cautioned from discussing the details of the situation <br />with(mt the Kaas, Mr. Dusbabek and Mr. Bower present. He advised the recommendation of the <br />l>cd, 1 ic Works Committee was to bring this to a work session with the neighbors present. <br /> <br />Cotmcilmcmbcr Elvig noted the other idea was that these residents may be able to negotiate an <br />agreement amongst themselves, which could be discussed at that work session. <br /> <br />Assistant Public Works Director Olson explained this topic came up as a result of a discussion <br />b~'twecn two of thc property owners this summer. They asked to be placed on the agenda, but <br />that meeting did not occur until September. With the discussion of the road being upgraded the <br />property owners did not know that they wanted it to be a Council topic any longer. <br /> <br />Counci lmember Jeffrey stated it should be considered whether a precedent would be set with the <br />ct(:termination et' the upgrade to the road. <br /> <br />City Council / October 11, 2005 <br /> Page 14 of 17 <br /> <br /> <br />
