This <br />information packet does not contain all of the specific codes for construction and should only be used as a guide. The permittee is responsible to meet all code <br />requirements applicable to each project. <br />Pool/Spa Definitions <br />A swimming pool is defined as any pool, permanent or portable, <br />above or below ground, and which is more than 24 inches in <br />depth and has a surface area which exceeds 200 square feet <br />(equivalent of 16 foot diameter). <br />A spa is defined as a unit primarily designed for therapeutic <br />and/or recreational use, which is not drained, cleaned or <br />refilled for each individual. It may include, but not be limited to: <br />hydro -jet circulation, hot water, cold water, mineral baths, air <br />induction bubbles or any combination thereof. Industry <br />terminology for a spa includes, but it not limited to: therapeutic <br />pool, hydrotherapy pool, whirlpool, hot spa, and hot tub. <br />Required Permits <br />Swimming pools which exceed both contain 5,000 gallons in <br />capacity and a 24" depth or more shall require a building <br />permit. Pools or spas less than 5,000 gallons do not require a <br />building permit; however; will require a zoning permit prior to <br />being constructed or installed. <br />The permit application shall be submitted with a site plan <br />showing the proposed location on the lot along with location <br />and proximity of other buildings and structures, lot lines and <br />septic system (if applicable). Also needed are the pool drawings <br />or specifications. <br />Construction Requirements <br />Precaution shall be taken during construction to avoid damage, <br />hazard or inconvenience to adjacent or nearby properties, and <br />to assure that proper care is taken in stock piling excavated <br />material in order to avoid erosion, dust, or other infringements <br />onto adjacent property. During construction of any in -ground <br />pool or spa, the construction area must be secured with a <br />portable fence which is not less than 4 feet in height. <br />1111111111111111111111111111 <br />Setback Requirements <br />Swimming pools and spas shall be setback a minimum of 10 feet <br />from all adjoining lots. For corner lots, swimming pools and <br />spas shall meet the required side yard setback for buildings in <br />the applicable zoning district. <br />Pools and spas shall not be located closer than 4 feet to the <br />principal structure, within 10 feet of the edge of septic tank(s) <br />and 20 feet of the edge of the drainfield. Pools and spas cannot <br />be located any closer than 3' from a private well.
