Finally, until the final rule becomes effective on April 1, 2022, the interim final rule <br />remains binding and effective.179 These requirements were not in effect under the interim final <br />rule and do not apply to funds used (i.e., obligated or expended) under the interim final rule <br />while it is in effect. In addition, recognizing that some recipients have taken significant steps <br />toward making a trust fund deposit or repaying principal on Title XII advances under the interim <br />final rule, such as the legislative appropriation of funds for this purpose, even if a formal <br />obligation has not occurred, Treasury will exercise enforcement discretion to not pursue <br />violations of this final rule provision (i.e., the requirement not to reduce benefits) for recipients <br />that have appropriated funds for this purpose prior to the date of adoption of the final rule <br />consistent with the laws and procedures in their jurisdiction.
