Pursuant to the requirements set forth in section 8(a) of Executive Order 13132, <br />Treasury certifies that it has complied with the requirements of Executive Order 13132. <br />Administrative Procedure Act <br />The Administrative Procedure Act (APA), 5 U.S.C. 551 et seq., generally requires public <br />notice and an opportunity for comment before a rule becomes effective. However, the APA <br />provides that the requirements of 5 U.S.C. 553 do not apply "to the extent that there is <br />involved ... a matter relating to agency ... grants." The APA also provides an exception to <br />ordinary notice -and -comment procedures "when the agency for good cause finds (and <br />incorporates the finding and a brief statement of reasons therefor in the rules issued) that notice <br />and public procedure thereon are impracticable, unnecessary, or contrary to the public interest." <br />5 U.S.C. 553(b)(B). The interim final rule was issued without prior notice and comment <br />procedures because it implemented statutory conditions on the eligible uses of SLFRF funds, and <br />addressed the payment of those funds, the reporting on uses of funds, and potential consequences <br />of ineligible uses to help address the economic and public health emergency. See the <br />"Supplementary Information" section of the May 17, 2021 interim final rule for the applicability <br />of the requirements of 5 U.S.C. 553. In addition, under the exception discussed in that section for <br />matters relating to agency grants, the requirements of 5 U.S.C. 553 also do not apply to this final <br />rule. After careful consideration of the comments received, this final rule adopts the May 17, <br />2021 interim final rule with the revisions discussed in this Supplementary Information. <br />401 <br />
