CASE # <br /> <br />REPORT FROM PUBLIC WORKS <br />By: Public Works Staff <br /> <br />I~ackground: <br /> <br />ri'he l'ublic Works Committee met on Tuesday, October 18, 2005 and discussed <br />Linc [bllowing five cases: <br /> <br />CITIZEN INPUT <br /> <br />Nolle <br /> <br />(;ASE #1 <br /> <br />Consider Request to Remove Drainage Pond at 5907 151st <br />Lane <br /> <br />Ilackground: <br /> <br />()n October 7, 2005 the City received a request from Karla Weiss requesting the <br />retrieval of a stormwater drainage pond from her property located at 5907 151st <br />[,anc. Mrs. Weiss is concerned about the presence of the pond as a potential <br />sal'cty hazard. This pond has been a part of the drainage plan for the area since <br />})zing developed in 1989 as a part of the Haubrich subdivision. The pending area <br />is covered with a drainage and utility easement. The City currently has <br />apl)roximately 90 such ponds in place to receive and treat stormwater prior to <br />discharge to natural wetlands and streams. Staff recommends denial of this <br />request. Mrs. Weiss requested the opportunity to address the Public Works <br />(:ommittcc. <br /> <br />('hris Weiss, 5907 151st Lane, stated they are open to suggestions on this project. <br />I I' thc pond cannot be removed they would like to look at an outlet being provided <br />because every time there is a rain of V2 inch or more there is flooding with <br />c'vcryonc's debris ending up in their yard. They are also concerned there will be <br />an addition to the east of them, and they are concerned about what will happen <br />when thc landscaping of the land begins to change. He has talked to the City <br />/\ttorney and is trying to get an answer about whose liability it would be if a child <br />wcrc to wander into the pond. The City Attorney has informed him if they were <br />to invite children to their property it would be under their insurance. He stated <br />rids should be identified as not being their liability because they did not put the <br />pond there. <br /> <br />~%taff further explained the water reaches a certain elevation and flows overland <br />along the rear of the lots to the wetland. Several years ago there was work done <br />to ensure some high spots were shaved down to ensure that the Weiss residence <br />remains dry. Staff has been to the Weiss property after the recent heavy rains and <br />Ibc water was quite a ways away from the residence. If staff needs to visit the site <br />again to bc sure there is sufficient head to move the water into the wetland they <br />arc willing to do that. <br /> <br />Motion to rccommend that the City Council deny the request to remove the <br />existing drainage pond. <br /> <br /> <br />
