During the review
process of this application, staff realized there are no standards or regulations for these
appliances in City Code. Due to their potential to create a nuisance for neighboring properties,
s~atT has drafted an ordinance to establish some basic regulations for these devices. He advised
the proposed ordinance would establish minimum standards for exterior solid fuel-fired heating
devices including both a minimum setback from property lines and installation requirements.
These requirements aim to minimize the potential nuisances created by these appliances such as
smol<c and/or cinders. The Planning Commission held a public hearing for the proposed
{)rdinancc during their regular meeting on September 1, 2005. There were no written or verbal
c{m, mcnts submitted. However, the Planning Commission raised several concerns and directed
stal~t' lo revise thc proposed ordinance accordingly.

Community Development Director Trudgeon reviewed the revisions made to the ordinance. He
indicated thc revised draft of the proposed ordinance was presented to the Planning Commission
at their October 6, 2005 meeting. The Planning Commission and staff recommend introduction
o1' thc proposed ordinance.

City Council / October 25, 2005
