0 DEVELOPMENT <br />1 . City Code Compliance. That the DEVELOPERS will develop the Plat in accordance with <br />the City Code, Section 9.50, entitled "Subdivision" <br />?. Conformance with Plan. The Plat shall be developed pursuant to the final plat consisting of <br />one sheet (1) sheet, prepared by Hakanson Anderson. <br />3. Incorporation of All City Code Requirements. That the recitals above and the provisions <br />of the City Charter, Subdivision Code, Zoning Code and Public Improvement Code of the <br />CITY as amended to date hereof, are incorporated herein by reference. <br />4. Dumping of Garbage. The DEVELOPERS shall adhere to all City ordinances relating to, <br />but not limited to, dumping of garbage, site development, construction debris, open burning, <br />etc. <br />II. <br />PERMITS AND OCCUPANCY: <br />5. Requirements for Building and Occupancy Permits. No building permit for any lot in the <br />Plat shall be issued until: (a) a Certificate of Survey, including that information required by <br />the CITY, has been supplied to the City Building Official; and (b) all the financial guarantees <br />required by the CITY have been satisfied. <br />6. Municipal Sewer. No Certificate of Occupancy for any dwelling constructed on any of the <br />lots in the Plat will be issued until the City's municipal sewer system is available for service <br />to the lots as determined by the City Engineer. <br />III. <br />FEES AND CHARGES: <br />7. Park Dedication. Park dedication shall be satisfied by the DEVELOPER making a cash <br />contribution in the amount of Two Thousand, Two Hundred Dollars ($2,200.00) for the <br />newly created Lot 1,. Block 1 Clemens Second Addition. <br />8. Park Trail Development Fee. The DEVELOPER shall pay a trail development fee in the <br />amount of Five Hundred and Fifty Dollars and no cents ($550.00) for Lot 1, Block 1, <br />Clemens Second Addition. <br />9. Sewer and Water Trunk and Lateral Fees. The DEVELOPER has paid the fees <br />associated with this outlot through the assessment issued in the Feasibility Study completed <br />by Steve Jankowski, Civil Engineer. At the time that a building permit is requested for the <br />new lot, the current Metropolitan Council Sewer Availability Charge ("SAC") and the City <br />—163— <br />
