CASE # 17
REQUEST FOR A CONDITIONAL USE PERMIT TO ALLOW FOR MOTOR
VEHICLE SALES WITH AN OUTDOOR DISPLAY AREA:
CASE OF LUMAX, LLC'-
By: Breanne Dalnes, Associate Planner
Background:
"L'he City received an application from Lumax LLC for a conditional use permit for a motor
vehicle sales business on the property located at 6246 Highway 10 NW.
The following items are enclosed for your information:
a) Site location map
b) Site Plan
c) Proposed Findings of Fact
Observations:
Lumax LLC is applying for a conditional, use permit to sell and display vehicles for sale at the
property located at 6246 Highway 10 NW. The site is zoned E-1 Employment and guided as
Places to Work in the Comprehensive Plan. The proposed use is only allowed by a conditional
isuse permit within this district.
The applicant would like to use the unoccupied site for the sale and outdoor display of vehicles.
There would be approximately 10 to 15 cars on the lot. The cars would be parked on the front
side of the lot that faces Highway 10 and along the western side of the site. The existing building
-would be used as a sales office.
City Code states that a conditional use permit can be obtained to conduct open or outdoor sales
as a principal use within an E-I Employment district if the following criteria are met:
1) That the use does not take up required parking spaces or loading areas and,
2) That the sales area is surfaced with asphalt or concrete material to control dust.
3) The standards on determining the suitability of granting the conditional use permit are
met, per Section 9.03.05 of City Code.
The site is paved in accordance with a site plan submitted on November 15, 1995, and was
inspected on July 28, 2000. The site work was considered in accordance with the submitted site
plan.
The subject property and the surrounding areas were consciously guided for manufacturing or
industrial uses in the 2001 Comprehensive Plan. This fact would put the request in conflict with
the requirement that the proposed request is harmonious with the objectives of the
Comprehensive Plan.
The existing building located on the site is currently vacant, and the site is generally
under utilized. There is a collision center/auto repair shop immediately adjacent to the site to the
—203—
