Board Member Johnson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION//05-10-341 <br /> <br /> O <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0743 RELATING TO A <br />REQUEST FOR A VARIANCE FROM FRONT YARD SETBACK REQUIREMENTS IN <br />THE R-1 RESIDENTIAL DISTRICT <br /> <br /> WHEREAS, Oakwood Land Development, Inc., hereinafter referred to as "Applicant", <br />has properly applied for a Board of Adjustment variance to the front yard setback requirement <br />established in Section 9.20.11 (R-1 Residential District) of the Ramsey City Code on the property <br />generally located east of Variolite Street at 161st Avenue N.W., proposed to be platted as <br />Sweetbay Ridge and legally described as follows: <br /> <br />Part of the Northeast Quarter of the Southeast Quarter of Section 16, Township 32, <br />Range 25, Anoka County, Minnesota <br /> <br />And <br /> <br />Part of the Southeast Quarter of the Northeast Quarter of Section 16, Township 32, <br />Range 25, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to <br />Section 9.03.07 of the Ramsey City Code on October 6, 2005, and that said'public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br /> <br />That Section 9.20.11 (R-1 Residential District), Subd. 4 (Bulk Standards), Metropolitan <br />Urban Service Area (MUSA), establishes a front yard setback of thirty (30) feet from the <br />right-of-way of public roads. <br /> <br />That the following parcels in the proposed plat were designed with a twenty-five (25) foot <br />setback fi'om the public road right-of-way: Lots 18, 19, and 39 through 92, as reflected on <br />the Preliminary Plat dated May 2, 2005, revised August 2, 2005. <br /> <br />That the Applicant has stated that the reduced setback is necessary for the following reasons: <br />a) ~naintain compliance with standard public street right-of-way requirements; b) reduce the <br />amount of wetland filling; c) increase wetland buffer widths; d) reduce the amount of tree <br />removal required. <br /> <br /> <br />
