o <br /> <br />That the Subject Property received preliminary plat approval as Sweetbay Ridge on August <br />23, 2005 and consists of 158 single family urban residential lots served by sanitary sewer and <br />municipal water. <br /> <br />6. That the August 23, 2005 preliminary plat approval was conditioned on the Applicant <br /> obtaining a variance to the front yard setback requirements. <br /> <br />7. That the special conditions causing the undue hardship, namely the presence of wetlands and <br /> substantial tree cover, do not result from the actions of the Applicant. <br /> <br />8. That if granted, the variance will not grant the Applicant any special privilege that is denied <br /> to other owners of lands, structures or buildings in the same district. <br /> <br />9. That if granted, the variance will not be materially detrimental to the purposes of the Ramsey <br /> Zoning Chapter or other property in the R-1 Residential District. <br /> <br />10. That if granted, the variance will not substantially increase the congestion of public streets, or <br /> increase the danger of fire, or endanger the public safety, or substantially impair property <br /> values within the neighborhood. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Levine, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Nixt <br />Board Member Johnson <br />Board Member Levine <br />Board Member Brauer <br />Board Member Van Scoy <br />Board Member Watson <br /> <br />and the following voted against the same: <br /> <br />Nolle <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br />Board Metnber Shepherd <br /> <br />Resolution #05-10-341 <br />Page 2 of 3 <br /> <br /> <br />
