POLICY BOARD BUSINESS <br /> <br />Case #1: Wetland Buffer Ordinance Update <br /> <br />Chairperson McDilda opened the meeting with the first order of business and asked Zoning and <br />Recycling Zoning & Recycling Coordinator Anderson to update the EPB members about the <br />Wetland Buffer Ordinance. Zoning & Recycling Coordinator Anderson stated for information <br />purposes, that the wetland buffer ordinance was discussed at length at the City Council work <br />session on September 20, 2005. He stated that it was a very healthy discussion, which seemed to <br />clarify many of the questions and/or concerns that Council members had regarding this draft <br />ordinance. At the City Council meeting on September 27, 2005, City Council, by a 5-1 vote, <br />officially introduced the ordinance. He stated that the next step will be to bring the ordinance <br />back to City Council for formal adoption. <br /> <br />Zoning & Recycling Coordinator Anderson stated that there was a little bit of information and <br />citizen input from Mr. Enstrom and Mr. Hunt at the meeting. He stated that it was helpful to <br />have Mr. Hunt's aerial photographs. Zoning & Recycling Coordinator Anderson stated that <br />there were mechanisms built into the ordinance for a procedure for variances and exceptions. <br />Zoning & Recycling Coordinator Anderson stated that he seemed to be comfortable to move this <br />forward to an official Council meeting. He stated that if it is adopted, it would then be published <br />in the newspaper and would take effect 30 days after publication. <br /> <br />Board Member Max asked for clarification about how long it would take for adoption. He asked <br />if there would be 30 days for it to be adopted as well. Zoning & Recycling Coordinator <br />Anderson clarified that would not be the case, that it could be adopted at the Council meeting. <br />He stated that Mr. Enstrom stated that he had been talking to his engineer and would be bringing <br />a report to Staff. Zoning & Recycling Coordinator Anderson stated that the City Attorney gave <br />Mr. Enstrom a deadline of the end of business on Wednesday prior to the upcoming Council <br />meeting. With that in mind, Zoning & Recycling Coordinator Anderson stated that if Mr. <br />Enstrom's report comes in on Wednesday afternoon, Staff would have Thursday to generate a <br />response for the Council meeting. However, if a response to the report cannot be generated in a <br />timely manner, the date could be pushed back. <br /> <br />Chairperson McDilda stated there was discussion with Community Development Director Pat <br />Trudgeon. Chairperson McDilda asked if it would be possible, if the EPB had on contract with <br />Peterson Environmental, to uphold the maps with wetland definitions within the City. He asked <br />if it would be possible to have that done within 30 days prior to ratification. <br /> <br />Zoning & Recycling Coordinator Anderson stated that he had not had an opportunity to follow <br />up on that. Zoning & Recycling Coordinator Anderson stated that in a conversation with Mr. <br />Arndt, Mr. Arndt stated it was his anticipation that by the end of October they would have <br />completed the GIS/data review portion of the study. That information would be available for <br />Staff in case the ordinance would go into effect and the map wasn't available. Zoning & <br />Recycling Coordinator Anderson noted that the other option would be to change the effective <br />date of this ordinance to become effective January 1 of next year.
