Green Valley Rd, and whether commercial and private vehicles could be parked and/or stored in <br />compliance with City Code~ <br /> <br />tn an effort to alleviate some of these concerns, Mr. Gu'zzo agreed to store the boom truck off- <br />site. However, thrm~ghout this summer and fall, the City, has received complaints on a regular <br />basis concerning the boom truck being parked at the property, Furthermore, City, Staff received a <br />complaint in September stating that the business activities seemed to be intensifying and that <br />there was manufacturing occurring welt past the permitted time of 5 pm. <br /> <br />Both the Planning Commission and City Council had some concerns regarding the compatibility <br />of this type of business in a residential area when Mr. Guzzo originally requested the Interim Use <br />Permit in April of this year. However, the Planning Commission and City Council were <br />concerned that denying that request may force the company out of business. Therefore, the City <br />Council approved a six (6) month.Interim Use Permit to provide Mr. Guzzo an opportunity to <br />either restructure the business so that it complies with City Code or to relocate the business to a <br />commercial sim. <br /> <br />The Planning Commission held a public hearing regarding the request for another Interim Use <br />Permit on December 1, 2005. Several concerns were raised by residents including increased <br />traffic on Green Valley Road generated by this business, the fact that business activities seem to <br />have intensified over the past six (6) months, some materials are now being stored outside, and <br />that work has continued well past 5pm, which said time was specified in the original Interim Use <br />Permit. <br /> <br />Recommendation: <br /> <br />Both City Staff and the Planning Commission feel that this business is not compatible with the <br />residential surroundings. The Planning Commission felt that this request should be denied; <br />however, they also realized that a certain amount of time would be necessary to facilitate the <br />relocation of the business and during said time, the conditions of an Interim Use Permit should <br />be in tact. Therefore, the Planning Commission recommended adopting negative findings but <br />approving an Interim Use Permit until March-31, 2006 specifically to allow Mr. Guzzo time to <br />relocate the business. <br /> <br />If the City Council is inclined to approve an Interim Use Permit, whether it is for a short period <br />of time to allow Mr. Guzzo to relocate the business or for the requested duration of eighteen (18) <br />months, positive findings will need to be adopted. However, if the City Council concurs that this <br />use is not compatible with the surrounding area, the City Attorney has advised that rather than <br />approving the request for a short period of time to allow the business to be relocated, the request <br />should simply be denied and by motion, declare a specific date by which time the business must <br />be relocated. City Staff has drafted a resolution that not only denies this request, but also <br />specifies March 31, 2006 as the date by which time the business must be relocated (the date <br />recommended by the Plarming Commission). <br /> <br />-324- <br /> <br /> <br />
