DEVELOPER further acknowledges, by <br />execution of this COntract, receipt of a copy of the afbrementioned ageements~ <br /> <br />In the event of a conflict between the terms of this Contract and the terms of the <br />aforementioned agreements shall control. <br /> <br />3. Conditions of Approval. The CITY hereby approves the Plat on condition that: <br /> <br />a. the DEVELOPER enters into this Contract, and <br /> <br />the DEVELOPER provides the necessary security in accordance with' the <br />terms of this Contract. <br /> <br /> 4. Development Plans. The DEVELOPER shall develop the Plat in accordance <br />with the Final Plat and Final Engineering Plans prepared by URS and dated July 8, 2005. The <br />plans shall not be attached to this Contract, but are in CITY files. <br /> <br /> 5. State I Improvements Required. The improvements the CITY requires <br />ILzkMSEY TOWN CENTER, LLC, to construct within the Plat are as follows: <br /> <br />ao <br /> <br />Trunk and lateral sanitary sewer system <br />Trunk and lateral watermains and appurtenances <br />Public streets with concrete curb and gutter (Sapphire Street.) - to be constructed <br />by Ramsey Town Center, LLC) <br />Trunk and lateral storm drainage facilities <br />Sidewalk Construction along Sunwood Drive and Sapphire St. <br /> Ramsey Town Center llth Addition <br /> Development Contract <br /> Page 2 of 11 Pages <br /> <br /> <br />
