Edward Hamilton, 6615 Highway #10 NW, Ramsey, stated that when the wind comes out of the <br />northwest the smell from the asphalt is quite bad, but did note it is not an every day problem. <br /> <br />Brent Schlueter, Commercial Asphalt, stated that he had a chance to speak with Mr. Hamilton <br />prior to the start of the meeting and requested that he contact him directly to determine what the <br />problem is and when it is happening to try and correct the situation. <br /> <br />Mr. Hamilton replied that he was agreeable to meeting with Mr. Schlueter. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Nixt, to close the public hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Commissioners Johnson, Nixt, Dempsey, <br />Jensen, and Kociscak. Voting No: None. Absent: Wivoda. <br /> <br />The public hearing closed at 8:45 p.m. <br /> <br />Commission Business <br /> <br />Chairperson Anderson called the regular meeting of the Planning Commission back to order at <br />8:45 p.m. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Nixt, to recommend that City <br />Council adopt findings of fact favorable to the applicant, but removing the words "fumes and <br />odors from #25, relating to Commercial Asphalt's request for a conditional use permit for a hot <br />mix asphalt plant. <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Commissioners Johnson, Nixt, Dempsey, <br />Jensen, and Kociscak. Voting No: None. Absent: Wivoda. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Jensen, to recommend that City <br />Council approve the issuance of a conditional use permit to Commercial Asphalt for a hot mix <br />asphalt plant based on the findings of fact. <br /> <br />Further discussion: Commissioner Dempsey inquired if the permit is granted will it only apply <br />to the applicant. Community Development Director Frolik explained that the current owners <br />could sell the business and the permit would continue. Commissioner Dempsey inquired if the <br />permit could it be terminated in a redevelopment situation. Community Development Director <br />Frolik replied that the permit can only be terminated if the company ceases operation or violates <br />the terms of the permit. <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Commissioners Johnson, Jensen, <br />Dempsey, Kociscak, and Nixt. Voting No: None.
