This variance is not valid unless certified by the Department of Natural Resources in <br />accordance with procedures established in Section 9.21.07 (Critical River Overlay <br />District Development Standards) and Section 9.23.06 (Scenic River District Provisions) <br />of the Ramsey City Code and until such time, no new impervious area may be added to <br />the Subject Property; however, existing impervious areas may be improved per the <br />approved grading and erosion control plan. <br /> <br />That the off-street parking area adjacent to 13740 Dolomite St shall be properly screened <br />and that said screening must be approved by the Community Development Department. <br /> <br />The required curbing to be installed along the southern property line shall be shall be <br />sufficient enough to prevent runoff from entering the adjoining property to the south. <br /> <br />The Permittee shall provide adequate space between the existing fence, owned by the <br />residents of 13740 Dolomite St NW, and the paving and curbing improvements, to allow <br />for periodic fence maintenance. <br /> <br />The Permittee shall be responsible to place any dumpsters in such a location(s) so that <br />they are as far as is feasible from the southern property line adjacent to 13740 Dolomite <br />St NW. <br /> <br />The property owner shall be subject to the site plan review process for any building <br />expansion that may occur in the future; however, if them is no net increase in impervious <br />ama, an additional variance to impervious area restrictions within the Critical River and <br />Wild and Scenic River Overlay Districts will not be necessary. <br /> <br />10. <br /> <br />The Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this variance. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Brauer, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Nixt <br />Board Member Johnson <br />Board Member Brauer <br />Board Member Shepherd <br />Board Member Van Scoy <br />Board Member Levine <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />RESOLUTION #05-07-200 <br /> Page 2 of 4 <br /> <br /> <br />
