Motion by Commissioner Dempsey, seconded by Commissioner Johnson, to approve the <br />following minutes as amended: <br /> <br />1) Planning Commission public hearing and regular meeting minutes dated May 2, 2000. <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Commissioners Dempsey, Johnson, <br />Kociscak, and Wivoda. Voting No: None. Absent: Commissioner Nixt. <br /> <br />NOTE CITY COUNCIL MINUTES <br /> <br />1) City Council public hearing and special meeting minutes dated April 11, 2000 <br />2) City Council public hearing and regular meeting minutes dated April 25, 2000 <br /> <br />PUBLIC HEARINGS/COMMISSION BUSINESS <br /> <br />Case #1: Request for Conditional Use Permit for Farm Animals; Case of Jeffrey Sigler <br /> <br />Chairperson Anderson closed the regular portion of the Planning Commission meeting at 7:05 <br />p.m. in order to conduct the public hearing. <br /> <br />Public Hearing <br /> <br />Chairman Anderson called the public hearing to order at 7:05 p.m. <br /> <br />Presentation <br /> <br />Community Development Assistant Wald stated that in February, the City received a complaint <br />on the property located at 17151 Baugh Street from a neighboring property owner. The <br />complaint was in regard to obnoxious odors generated by the cows and horses being maintained <br />on the property. Also, the complainant stated that the homeowner was piling manure in the <br />ditch of County Road #83 (Armstrong Blvd.). Staff conducted an inspection on March 16, 2000 <br />and could not verify any bad odors or manure being disposed of in the ditch. However, Staff did <br />find at this time that Mr. Sigler was maintaining three (3) cows on the property, absent of the <br />required conditional use permit. On May 16, 2000, the City received an application from Jeffrey <br />Sigler requesting a conditional use permit to maintain three (3) cows on his property. The <br />subject property is zoned R-I(R) Single Family Rural Residential. The surrounding properties <br />are also zoned R-I(R) Single Family Rural Residential. The subject property is approximately <br />ten (10) acres in size. City Code states that parcels three (3) to twenty (20) acres in size are <br />restricted to a maximum of or a combination of two (2) goats, pigs, or cows, with the issuance of <br />a conditional use permit. The applicant currently has three (3) cows on his parcel. Mr. Sigler is <br />asking for a conditional use permit to continue maintaining three (3) cows on his ten (10) acre <br />parcel. Mr. Sigler also has five (5) horses and two (2) sheep on his property. The applicant stated <br /> <br />Planning Commission/June 6, 2000 <br /> Page 2 of 13 <br /> <br /> <br />
