Further discussion: Commissioner Nixt advised the residents to follow through with the sketch
plan and preliminary plat of the property because it may be possible to achieve a modified
density of the property. Commissioner Dempsey stated that it is difficult to vote against the
rezoning because of the Comprehensive Plan indicating the property as R-1 Urban Residential,
but noted that the development will probably be close to the compromise plan that was presented
to the developer by the residents because of the City Charter Amendment. Chairperson
Anderson stated that he questions the action that was taken that included this particular land into
the MUSA, but the only other choice would be to vote to remove the land from the MUSA, but
he does not intend to pursue that and for that reason, he will vote in favor of the rezoning.

Motion Carried. Voting Yes: Chairperson Anderson, Commissioners Johnson, Nixt, Dempsey,
Kociscak, and Reeve. Voting No: None. Absent: Commissioner Wivoda.

Motion by Commissioner Johnson, seconded by Commissioner Nixt to consider Case #5.

Motion Carried. In addition, the Zoning and Subdivision Chapter of City Code has not
been updated to implement the Comprehensive Plan being proposed. A very important aspect of
the draft Comprehensive Plan is that language which would establish density standards for new
development abutting existing development. It will take many months to update the Zoning and
Subdivision Chapter and in the interim, the moratorium is expiring on various parcels. The draft
ordinance proposes that the density on the common border between new and existing
development be equal or less than the existing density, but the minimum lot size will not be
greater than one acre. The remainder of the newly developing property within 1,000 feet of the
common border with existing development shall be restricted to a density of two units per acre.
New development will also be subject to a traffic generation analysis. She explained that the
City Attorney is recommending that the current Zoning Chapter be amended to establish density

Planning Commission/July 10, 2000
