Commissioner Dempsey inquired if the use of the detached building would require a separate <br />Certificate of Occupancy. <br /> <br />Community Development Director Frolik replied that that would be a question for the building <br />inspector, but she would assume so. <br /> <br />Commissioner Kociscak stated that the original findings of fact should be considered when <br />making a decision on this case. <br /> <br />Commissioner Dempsey inquired if the previous findings of fact were written prior to <br />construction of the detached building or after. <br /> <br />Community Development Director Frolik replied that they were written during construction. <br /> <br />Commissioner Dempsey stated that he did not think that the previous findings of fact were <br />relevant at this time. <br /> <br />Chairperson Nixt stated that the current request is for an interim use permit which would allow <br />the applicant to complete the structure and giving them time to construct the breeze way. The <br />accessory structure is already connected by a tunnel, the structure already exists and he sees <br />mitigating circumstances and want to assure that they won't be looking at a 50 foot wall and give <br />them the relief they are asking for and give the residents the relief they want by limiting their <br />use. <br /> <br />Commissioner Kociscak inquired if the business could operate without the living quarters. <br /> <br />Ms. Smith replied that it would be easier for the nurse to have her own living area because it <br />becomes very stressful living on-site, but they could operate without the additional living <br />quarters. <br /> <br />Chairperson Nixt inquired as to what the area would be used for if it is not used as a living <br />quarters. <br /> <br />Ms. Smith replied that it would be left vacant. <br /> <br />Chairperson Nixt inquired if the applicant would be willing to work with staff on some type of <br />landscaping plan around the building. <br /> <br />Ms. Smith replied yes. <br /> <br />Mr. Obrey inquired if the second dwelling has not been inspected, would category 1 requirement <br />be enforced on the existing house also. <br /> <br />Planning Commission/September 5, 2000 <br /> Page 8 of 13 <br /> <br /> <br />
