Commissioner Dempsey replied yes. <br /> <br />Mr. Baird inquired as to why the previous owner was not forced to take down the structure when <br />he was denied the conditional use permit. <br /> <br />Community Development Director Frolik replied that the unit was never developed into an <br />apartment. <br /> <br />Chairperson Nixt stated that the residents are opposed to the use of the building as a detached <br />building, but if the applicants were to connect the two buildings as one, they could not prohibit <br />the living quarters. <br /> <br />Mr. Baird inquired as to what would happen if Loving Care sells the property, could it be used as <br />a rental property. <br /> <br />Chairperson Nixt stated that he would like restrictions placed on the permit that would prohibit <br />that from happening. <br /> <br />Mr. Baird replied that the permit should only be granted to the current owners. <br /> <br />Al Carlson, 8251 163rd Avenue, Ramsey, stated the he is opposed to the use as an apartment until <br />they can prove what it is suppose to be and the amount of traffic that will be increased in the <br />neighborhood. <br /> <br />Motion by Commissioner Kociscak, seconded by Commissioner Wivoda, to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Kociscak, Wivoda, Dempsey, <br />Griffiths, and Reeve. Voting No: None. <br /> <br />The public hearing closed at 9:20 p.m. <br /> <br />Commission Business <br /> <br />Chairperson Nixt called the regular meeting of the Planning Commission back to order at 9:20 <br />p.m. <br /> <br />Chairperson Nixt stated that he does not see any reason why the owner should be predisposed to <br />attach the garage other than to meet City Code and questioned why would the surrounding <br />residents want the applicant to construct a 50 foot breeze way, for instance, that they would have <br />to look at. He explained that the City has granted conditional use permits in similar situations <br />and that the Commission could either deny the request outright or put together a conditional use <br />permit that would not require the connection between the two buildings and limit the use to the <br />senior care facility or equivalent, but not be rented out at large. <br /> <br />Planning Commission/September 5, 2000 <br /> Page 7 of 13 <br /> <br /> <br />
