"FIRST AMENDMENT TO CITY OF RAMSEY <br />MASTER DEVELOPMENT AGREEMENT <br /> FOR RAMSEY TOWN CENTER <br /> By and Between <br /> CITY OF RAMSEY <br /> And <br /> RAMSEY TOWN CENTER LLC <br /> Dated February 28, 2005 <br /> <br />(the "First Amendment") <br /> <br />The terms and conditions of the aforementioned agreements are incorporated herein by <br />reference as if fully set forth at this point. DEVELOPER further acknowledges, by <br />execution of this Contract, receipt of a copy of the aforementioned agreements. <br /> <br />In the event of a conflict between the terms of this Contract and the terms of the <br />aforementioned agreements shall control. <br /> <br />3. Conditions of Approval. The CITY hereby approves the Plat on condition that: <br /> <br />the DEVELOPER enters into this Contract, and <br /> <br />the DEVELOPER provides the necessary security in accordance with the <br />terms of this Contract. <br /> <br /> 4. Development Plans. The DEVELOPER shall develop the Plat in accordance <br />with the Final Plat and Final Engineering Plans prepared by URS and dated December 21, 2005. <br />The plans shall not be attached to this Contract, but are in CITY files. <br /> <br /> 5. -Staee I Improvements Required. The improvements the CITY requires <br />RAMSEY TOWN CENTER, LLC, to construct within the Plat are as follows: <br /> <br />g. <br />h. <br />i. <br /> <br />Trunk and lateral sanitary sewer system <br />Trunk and lateral watermains and appurtenances <br />Trunk and lateral storm drainage facilities <br />Public Streets (not. applicable; constructed by others as part of Ramsey Town <br />Center 8th Addition) <br />Sidewalk connections to the sidewalkg and trail along Zeolite Street N.W., Bunker <br />Lake BLvd. N.W., and Willemite Street N.S.Construcfion along Town Center <br />Drive, 147th Lane, 147th Terrace, Willemite Street and Xenolith Street. <br />Natural gas <br />Telephone service <br />Electric service · <br />Street lights (installment arranged by the CITY during Stage I Improvements and <br />paid for by DEVELOPER as Stage II Improvement) <br />Site grading in accordance with the Grading Plan prepared by URS dated <br />December 21, 2005 <br /> Ramsey Town Center 12th Addition <br /> Development Contract <br /> Page 2 of 13 Pages <br /> <br />-227- <br /> <br /> <br />
