Karina Higareda, 6720 158th Lane NW, stated they appreciate the Council looking into this and
reading the letters of the property owners.

Mayor Gamec stated he understands the safety factor with things such as people walking through
their yards. The Council will definitely consider that impact.

Maynette LaDue, 15821 Dolomite Street NW, stated their land is totally fenced and they do not
want a walking path going through the middle of their property. They realize they may have to
have a sewer line going through their property, but would prefer it along the south border of the
property, rather than the highest part of the property. With the sewer line in the planned location
they would lose about I/3 of their pasture and it could impact development of their land in the
future. She questioned ifa house could be built on top of the sewer.

Assistant Public Works Director Olson responded in the negative. He explained the details of
the sewer line can be reviewed; however, any changes to the plan may impact other property
owners.

Pete LaDue, 15821 Dolomite Street NW, stated everything on the south side of the ditch is
useless and would be a better location than what is planned.

Councilmember Elvig noted Mr. LaDue has a valid point. The property owners do not feel as
though they have the right pathway through their property and are suggesting another route. Mr.
LaDue is suggesting that people have not been out to look at the route. He explained this has
been a long study and there have been public open houses and comment periods where people
have come in and pinpointed their property. All of those comments were compiled and the City
has done their best to shift those lines back and forth. There may still be an opportunity to make
changes, but the property owners should contact City Engineer Olson to come out and look at the
property.

Cecilia LaDue, 6716 158th Lane NW, stated one of their first concerns is that there have been
public meetings and opportunities to discuss a lot of this information, but they have not received
a lot of that information, and have not been notified when the public meetings have occarred.
Councilmember Elvig informed them this would be discussed this evening, with the possible
condemnation, but they did not receive a notice in the mail. Their primary concern is the trail
going through their back yard. They have developed a wildlife area in their back yard; their
pond goes out into the wetlands and they have developed trees along that area. The proposed
trail and the flowage ditch go through there.

Mayor Gamec suggested the LaDue's meet with Mr. Olson regarding the trail.

Councilmember Elvig stated the City has spent a lot of time on feasibility and public input
regarding the sewer line. He is not certain how contentious the placement of the trail may be.
He suggested the same type of effort that was put into the sewer line placement could be put into
the trail placement. He noted the placement of the trail may be more important, as it is on the
surface. He suggested any action tonight separates the sewer and trail easements.

City Council / December 13, 2005
