Community Development Director Frolik noted that letters were received from Mr. and Mrs.
David Trushenski, 14533 Bowers Drive NW, Ramsey, and John and Joanne Jacobson, 14691
Bowers Drive NW, Ramsey, both expressing opposition in granting of the variance.

Chairperson Anderson inquired as to when Mr. Boyum purchased the property.

Mr. Boyum replied in 1994.

Chairperson Anderson inquired if both pieces of property were purchased at the same time

Mr. Boyum replied yes.

Chairperson Anderson inquired if originally the two lots had a common property identification
number and now have two separate identification numbers.

Mr. Boyum replied yes and explained that he did so to make Lot 30 buildable.

Chairperson Anderson questioned what Mr. Boyum feels the hardship would be if the variance is
denied.

Mr. Boyum replied that if the variance is not granted and he is required to construct the home
200 feet from the high water mark, the home would be on the road and not the river. This is
different than all of the other homes constructed along Bowers Drive and would diminish the
value of the lot.

Chairperson Anderson inquired about the illegal tree cutting that took place on Lot 30.

Mr. Boyum replied that the tree cutting incident was a mistake. He did not realize that he could
not cut large trees on his lot and was only trying to prepare the property to construct the house.

Chairperson Anderson inquired if there has been lot preparation in anticipation of constructing
the home on Lot 30.

Mr. Boyum replied yes, tree removal.

Chairperson Anderson inquired if there has been any building permit or any other permit applied
for or issued at this point.

Mr. Boyum replied no, but noted that Mr. Hovey, from the DNR, was supportive of the house
during their meeting.

Community Development Director Frolik noted that the DNR is obligated to certify the variance
if granted.

Board Member Kociscak inquired if the existing home is a walkout.

Board of Adjustment/February 1, 2000
