street frontage requirements contingent upon the applicant entering into a variance agreement with
the City. The proposed variance is identical to the one approved in 1998.

Board Business

Motion by Board Member Johnson and seconded by Board Member Kociscak to adopt
Resolution #00-04-079 adopting Findings of Fact #0514 relating to Larry Skogquist's request for
a variance from the street frontage or lot width requirement.

Further discussion: Chairperson Anderson stated he would not be voting in favor of this
variance. He stated he does not agree with condition #6 of the resolution as the property abuts
County Road #63 in one location and not two. Community Development Director Frolik stated
that both of the parcels are under one PIN number, and if this is not the case, a lot combination
should be a condition of approval. Board Member Dempsey asked if it will be a recordable
easement. Community Development Director Frolik stated it would be a recordable easement.

Motion carried. Voting Yes: Board Members Johnson, Kociscak, Dempsey, and Wivoda.
Voting No: Chairperson Anderson. Absent: Board Member Nixt.

Motion by Board Member Johnson and seconded by Board Member Dempsey to approve Larry
Skogquist's request for a variance from the street frontage or lot width requirement based on
Findings of Fact #0514 and adopt Resolution #00-04-080 declaring terms of same.

Motion carried. City Code also stipulates that in the rural residential service
area the minimum lot size is ten (10) acres. A literal interpretation of City Code would require
that three (3) lots meet the ten (10) acre minimum lot size requirement and the 8.7 acre remnant
be platted as a fourth lot. Due to the long and narrow configuration of the property, the most
reasonable plat design results in lot sizes of 9.89, 9.60, 9.79, and 9.1. This also results in Lot 1 &

Board of Adjustment/April 4, 2000
