Public Hearing <br /> <br />Chairperson Anderson called the public heating to order at 7:07 p.m. <br /> <br />Presentation <br /> <br />City Planner Rasmussen explained that Eugene Hawk is requesting a variance to construct a garage <br />nearer the front property line than the principal structure at 9468 176~h Avenue NW. The house is <br />located 271 feet from the nearest point on the right-of-way, and Mr. Hawk proposes to construct a <br />garage approximately 217 feet from the nearest point of the right-of-way. The approximate 7.3- <br />acre parcel is significantly covered by wetlands and mature tree growth prohibiting construction of <br />a garage in the side or rear yard. There are two accessory garages on the property, one is 12'x16' <br />and the other is 8'x8'. The garage attached to the principal structure is 24'x24'. The existing <br />garages along with the proposed garage are well within the size restrictions established by City <br />Code for parcels 7.3 acres in size. The mature tree growth in the area and the alignment of <br />neighboring homes around the street are such that there should be no adverse impact to the <br />neighbors' view of the street by the construction of the proposed garage. Because of the physical <br />features of the Hawk property, Staff recommends approval of the variance. <br /> <br />Citizen Input <br /> <br />There was none. <br /> <br />Upon inquiry, Mr. Hawk stated that the 8'x8' structure will eventually be taken down. <br /> <br />Motion by Board Member Dempsey and seconded by Board Member Wivoda to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Board Members Dempsey, Wivoda, <br />Kociscak, and Nixt. Voting No: None. Absent: Board Member Johnson. <br /> <br />The public hearing was closed at 6:35 p.m. <br /> <br />Board Business <br /> <br />Chairperson Anderson called the special meeting of the Board of Adjustment back to order at 6:35 <br />p.m. <br /> <br />Motion by Board Member Nixt and seconded by Board Member Dempsey to adopt Resolution <br />#00-04-094 adopting Findings of Fact #0517 relating to Eugene Hawk's request for a variance, <br />amending the following findings to read: <br /> <br />7. That the City Code allows for a total of 4064 square feet of garage and accessory buildings <br /> on the subject property; the proposed garage is 1200 square feet in size; there are two <br /> <br />Board of Adjustment/April 18, 2000 <br /> Page 2 of 4 <br /> <br /> <br />
