smaller accessory buildings on the property which total 256 square feet and the garage <br />attached to the principal structure which is 576 square feet. This results in a total of 2032 <br />square feet of garage and accessory building space. <br /> <br />That there are special conditions applying to the Subject property that do not generally apply <br />to other properties in the district; namely the side yards contain wetlands and mature tree <br />growth and that placement of the proposed structure in compliance with applicable provisions <br />of City Code is infeasible. <br /> <br />That if granted, the variance will not impair an adequate supply of light and air to adjacent <br />property. <br /> <br />That if granted, the variance will not unreasonably increase the congestion in the public <br />street. <br /> <br />That if granted, the variance will not increase the danger of fire or endanger the public <br />safety. <br /> <br />That if granted, the variance will not unreasonably diminish property values in the <br />neighborhood. <br /> <br />That if granted, the variance will not violate the intent of the Comprehensive Plan. <br /> <br />That, if granted, the variance will not grant the Applicants any special privileges that is <br />denied to other owners of land in the same district. <br /> <br />Motion carried. Voting Yes: Chairperson Anderson, Board Members Nixt, Dempsey, Kociscak, <br />and Wivoda. Voting No: None. Absent: Board Member Johnson. <br /> <br />Upon inquiry, Mr. Hawk stated the purpose of the accessory structure is for personal storage. <br /> <br />Motion by Board Member Dempsey and seconded by Board Member Wivoda to approve Eugene <br />Hawk's request for a variance to construct a garage nearer the front property line than the <br />principal structure, based on Findings of Fact #0517, and adopt Resolution//00-04-095 declaring <br />terms of same, amending No. 3 to read "... shall not be located any closer than 210 feet from the <br />nearest point of the street right-of-way." <br /> <br />Motion carried. Voting Yes: Chairperson Anderson, Board Members Wivoda, Nixt, Dempsey, <br />and Kociscak. Voting No: None.
