CC Regular Session 5.10. <br />Meeting Date: 02/14/2023 <br />Submitted For: Bruce Westby, Engineering/Public Works <br />By: Marsha Weidner, Engineering/Public Works <br />Information <br />Title <br />Adopt Resolution #23-03 5 Authorizing Final Payment to Novco, Inc. for Improvement Project #22-01, Sunwood <br />Drive and Waco Street Reconstruction. <br />Purpose/Background: <br />Resolution and Pay App Request Attached. <br />Observations/Alternatives: <br />Issuing final payment will be contingent on receipt of the following items from Novco, Inc.: <br />L IC 134 (Contractor's Withholding Affidavit showing compliance with the provisions of Minnesota Statute <br />290.92 requiring withholding state income tax) <br />2. Waiver of Mechanic's Lien Rights (Affidavits that all claims against Novco, Inc. by reasons of the contract <br />have been fully paid or satisfactorily secured) <br />3. Consent of Surety to Final Payment (Certification from the contractor's surety) Following receipt of these <br />items, final payment will be issued. <br />The final project cost was $590,508.66 compared to the awarded contract price of $560,896.85. This was an <br />increase of $29,611.81. A large portion of this was due to increased quantities in curb and gutter replacement and <br />bituminous paving.
