Case #6: Consider Approval of Acquisition of Easements for the NW Trunk Sanitary <br /> Sewer Extension <br /> <br />Assistant Public Works Director Olson indicated the background of this case is included in the <br />Council's packet. He reviewed that November 22, 2005 was the last time the City Council <br />approved acquisition of parcels for this project. On December 13, 2005, the City Council <br />authorized the use of eminent domain for the remaining pamels for the sewer line only. There <br />are approximately 52 properties along the selected alignment. The elimination of the trail has <br />been well received by the remaining parcels, and one parcel that will be obtained from Oakwood <br />Land Development for one dollar. Nineteen of the property owners have signed an agreement <br />and have been paid. Five of the properties are tl~ough existing easements. The five negotiations <br />before the Council tonight have signed an agreement but have not been paid. Seven property <br />owners have given verbal approval contingent on the elimination of the trail. There are 16 <br />properties remaining, which include ten sanitary sewer easements and six ditch easements. The <br />project can go forward without the ditch easements, which is why the value of the ditch easement <br />is lower. Staff will continue to work on the remaining 16 properties and expect to have these <br />wrapped up by the time the contract is awarded in February. Staff recommends approval of the <br />completed negotiations with the five property owners for a total of approximately $21,052.00. <br /> <br />Councilmember Strormnen directed staff to inform the Park Commission of the action taken by <br />the Council to eliminate the trail easement from the easement acquisitions. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Cook, to approve the completed <br />easement acquisitions for properties along the NW sanitary sewer alignment. <br /> <br />Further discussion: Councilmember Elvig inquired if the concerns of the property owners <br />relating to the trail easement have been resolved. Assistant Public Works Director Olson replied <br />the results were positive. The alignment of the sewer was able to be changed, and the trail was <br />eliminated. Three of the seven property owners have verbally agreed, but the paperwork has not <br />been completed. Mayor Gamec requested verification that park trail easements are still being <br />included where it is possible. Assistant Public Works Director Olson responded in the <br />affirmative. He explained the trail easements have been separated out; some property owners <br />have signed trail easements, but there will not likely be a complete system. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Cook, Jeffrey, Olson, <br />Pearson, and Strommen. Voting No: None. <br /> <br />Case #7: <br /> <br />Approve Plans and Specifications and Authorize Advertisement for Bids for <br />Improvement Project 03-20, NW Trunk Sewer and Water Project <br /> <br />Assistant Public Works Director Olson explained the background information for this case is the <br />same as for the previous case, as it is the same project. There has been a lot of cost cutting done <br />to make this project more reasonable. Staff feels close enough with the design work to request <br />approval of plans and specifications and authorization to advertise for bids for the project <br />tonight.
