Mr. Olson advised bids will not be opened until <br />enough easements have been acquired to go forward with the project. Staff expects to begin <br />~vork in February before the frost goes out of the ground so the ditch can be cleaned with <br />minimal disruption. <br /> <br />Councilmember Elvig asked if there is strong language included for direction regarding the type <br />of restoration affecting the properties. He stressed concern that the language be strong enough, <br />as the project will include cutting through ditches and people's back yards. <br /> <br />Assistant Public Works Director Olson replied the alignment will be staying as close to the <br />middle of the wetland as possible. There is a wetland replacement plan that includes specific <br />details about what can be planted, and whenever the City disturbs someone's manicured back <br />yard they will sod and be very specific on how it is restored. <br /> <br />Councilmember Elvig asked if there is a final agreement in place with Oakwood Land <br />Development regarding their contribution to this project. <br /> <br />Assistant Public Works Director Olson replied there is not. The staff recommendation states that <br />the opening of bids and award of the contract will be contingent on the signing and finalization <br />of the Agreement with Oakwood Land Development for the $6 million contribution and <br />finalizing of easement acquisition process. Bids will not be opened until there is an executed <br />contract with Oakwood Land Development for the $6 million contribution. <br /> <br />City Attorney Goodrich indicated legal counsel for Oakwood Land Development has provided a <br />fairly well drafted document, which is being reviewed by the City's bond cotmsel. There are <br />very few issues remaining, and it is fully expected to have the agreement on January 24th. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Jeffrey, to adopt a Resolution <br />#01-06-011 approving the plans and specifications and authorizing the advertisement for bids, <br />contingent on the signing and finalization of the agreement with Oakwood Land Development <br />for the $6 million contribution and finalizing of easement acquisition process. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Jeffrey, Elvig, Olson, <br />Pearson, and Strommen. Voting No: None. <br /> <br />Case #8: <br /> <br />Adopt Resolution Supporting Anoka County Request to Add Segments of <br />CR 116 and CR 56 to the County State Aid Highway System <br /> <br />Assistant Public Works Director Olson stated the City has been contacted by the Anoka County <br />Highway Department, requesting that the City support the request by Anoka County to designate <br />2.39 miles of CR 116 from CR 83 to CR 57; and the entire 3.00 miles from Highway 10 to <br />CSAH 5, as roadways to be added to the County State Aid Highway System. Similar to the <br />Municipal State Aid System this designation will allow these segments of roadway to become <br />eligible for funding from gas tax revenue that is distributed to local governments from the state. <br />Mr. Olson explained the City must concur with this designation to have these segments added to <br /> <br />City Council/January 10, 2006 <br />Page 11 of 18 <br /> <br /> <br />
