CASE / D <br /> <br />DISCUSSION OF PROPOSED ADDITION OF SECTION 9.27 (URBAN STORM <br />WATER POLLUTION CONTROL FOR NEW DEVELOPMENTS) <br /> OF THE ZONING CHAPTER OF CITY CODE <br /> By: Leonard Linton, Civil Engineer II <br /> <br />Background: <br /> <br />The City is required to comply with the National Pollutant Discharge Elimination System <br />Phase II (NPDES II) as administered by the Minnesota Pollution Control Agency <br />(MPCA). The City filed a 5 year plan in 2003 outlining goals for reducing storm water <br />pollution. The MPCA provided some mandatory goals, including adoption of an erosion <br />control ordinance, including a time line for adoption of the ordinance. We currently have <br />some language in code addressing erosion control; however most does not have <br />enforcement provisions. This draft ordinance is modeled on the MPCA draft ordinance. <br />It has been pared down to eliminate language regarding trout streams and other features <br />not found in Ramsey. Additional discussion is needed on implementing and enforcing <br />the provisions of the ordinance. <br /> <br />Observations: <br /> <br />Most municipalities in Minnesota have to comply with these requirements so additional <br />examples are available. Dialog has been opened with several city representatives <br />regarding what techniques they have found to be most effective. <br /> <br />Recommendations: <br /> <br />Staffrequests comments on the ordinance and recommends the adoption process proceed. <br /> <br />Commission Action: <br /> <br />Will be based on discussion. <br /> <br />PC: 02/02/06 <br /> <br />85 <br /> <br /> <br />
