CASE # 2 <br />Review of Tree Preservation Ordinance <br />By: Chris Anderson, Zoning & Recycling Coordinator <br />Background: <br />The tree preservation ordinance has been in effect now for approximately two (2) years. After <br />working with this ordinance, it is apparent that at least certain portions of it need to be revisited. <br />Furthermore, this is a good opportunity for the new members of the EPB to become acquainted <br />with these rules and regulations. <br />The following items are enclosed for your information: <br />a. Current tree preservation ordinance (Exhibit 1) <br />b. Outline of canopy cover formula (Exhibit 2) <br />Observations: <br />The following are some additions, revisions, and/or clarifications that Staff would like to see <br />incorporated into this ordinance: <br />• In 9.24.01 (General Provisions) Subd. 4 (Definitions) <br />1. A definition for "significant tree" should be developed, which should also include a <br />minimum DBH; <br />2. The definition of boulevard needs to be revised so that it better matches the boulevard <br />definition in Section 9.02 of City Code. <br />3. Staff is looking for clarification of the purpose of the definition of a Zoning Buffer and <br />is unsure if this is necessary. <br />• In 9.24.04 (Private Trees in New Development Areas) <br />1. Subd. 3 (Plan Specifications Content), should note that all "significant trees" be <br />included on the tree preservation plan. <br />2. In Subd. 3 b. should there be a caveat for other qualified persons to conduct tree <br />inventories? <br />3. Subd. 8 a. (Planting Requirements) requires that after planting, all trees be protected <br />with a biodegradable tree tube. Staff would like to discuss this requirement. <br />4. Subd. 8 i. (Vision Clearance) should reference Section 9.11.01 (General <br />Requirements) Subd. 7 which has been established by our Public Works to maintain <br />safe and unobstructed views at intersections. <br />5. Staff would recommend considering a standard for planting distance from a residential <br />driveway for trees that are to be installed in the boulevard area. <br />6. Subd. 8 k. (Tree Preservation Tree Density Standard Calculation) states that if <br />removals exceed this standard, than replacement shall be consistent with the tree cover <br />requirements in the R-2 or R-3 zoning districts.
