Subd. 9 (Replacement of Trees) states that a developer shall be required to maintain <br />trees for one (1) year after the trees are planted. However, for multi -family <br />developments, developers are responsible for trees for a two (2) year period from the <br />time of planting. In single family developments, many times the planting requirement <br />is satisfied by an individual home owner. <br />8. Staff would like to discuss trees located in wetlands or other areas that will not be <br />disturbed throughout the development process. In Staff's opinion, it does not seem <br />necessary to have these trees individually identified. Staff will be looking for further <br />direction on this matter. <br />• In 9.24.05 (Hazardous and/or Nuisance Trees) Subd. 2 b., should oak wood be included? <br />While not specifically incorporated into the tree preservation ordinance, Staff would also like to <br />look at the canopy cover formula and how that has translated into planting requirements. Staff <br />would like clarification as to whether wetlands should be included in the calculation of required <br />canopy cover square footage. Title. The short title of this Section shall be known as the Tree <br />Ordinance and will be hereinafter referred to as the "Tree Ordinance". <br />Subd. 2. Purpose. The purpose of this ordinance to enhance the community <br />and its citizenry, and not to be punitive or to cause hardship to any individual, private or public <br />company. <br />Subd. 3. Intent. The intent of the Tree Ordinance is to provide regulations <br />relating to the removal of trees to promote the orderly development of such areas and thereby <br />minimizing public and private losses. Furthermore, the Tree Ordinance will establish and maintain <br />appropriate levels of diversity among tree species and age classes to provide a stable and <br />sustainable community forest.
