The Committee was presented with a letter from Mr. Kevin Hoglund of MnDOT responding <br />favorably to this proposal. Mr. Jankowski explained that Mr. Rademacher owns Parcel #2 and is <br />working with a developer who is proposing combining Parcel #2 with Parcel #3 to construct a <br />townhome complex. A portion of the concept plan suggests utilizing Cobalt Street to connect the <br />neighborhood to 153rd Avenue rather' than Barium Street, which has been objectionable to the <br />medical clinic. He also noted that the developer's plans utilized the eastern most portion of Lot <br />#2, which has been previously suggested as being turned over to the City. The City would make <br />use of this parcel to relocate a problematic ponding area in Willow Ridge or the east side of <br />Barium Street. A preliminary analysis suggests that sufficient areas for. drainage and the <br />townhomes would exist, particularly if the clinic would allow the existing pond to be "squared <br />up" by allowing its expansion in its southwest coruer. Mr. Jankowski stated that although this <br />proposal may be somewhat complex, since it would involve three property owners and the City <br />of Ramsey, it has several potential benefits: <br /> <br />1) Reduce two potential accesses onto T.H. #47 from Parcels 2 and 3 to a single ingress access <br /> only. <br />2) Provide an access from the neighborhood to 153~d Avenue and a signalized intersection. <br />3) Meet the needs of the clinic, which hopes to expand eastward and, thereby, perhaps settle the <br /> cun'ent condemnation action. <br />4) Provide for a solution to the drainage problem experienced in the Willow Ridge subdivision. <br /> <br />Staff recommended proposing a swap of the right-of-access from parcels two and three to <br />MnDOT in return for constructing an ingress only access into parcel #1 contingent upon: <br /> <br />1) The sufficient drainage easement be dedicated to the City to expand the clinic wetland, such <br /> that the northerly sedimentation pond in Willow Ridge can be abandoned; and <br />2) The non-federal portion of the construction of the ingress access be reimbursed to the City; <br /> and <br />3) That Rademacher, Inc. dedicates as right-of-way the eastern 60 feet of Parcel #1 as Barium <br /> Street. <br /> <br />Councilmember Hendriksen stated that the Council has taken the position that a business does <br />not automatically have right of access if the parcel has access from another way. He indicated <br />that Parcel #2 has access along Barium Street and Parcel #3 has access from Cobalt Street. He <br />also indicated that he would not "cut a deal" that is contingent upon the assumption that there <br />will be a high density configuration adjacent to single family homes. He requested that in the <br />future staff prepare cases pertaining to right of access using the wording "right of access claimed <br />by.." or wording recommended by the City Attorney, which would more accurately reflect the <br />Cities position. <br /> <br />Councilmernber Zimmerman inquired if it is the perception of Bill's Superette that since the state <br />highway approved to the right-in access they will receive the access. <br /> <br />City Engineer Jankowski replied no. <br /> <br />Councihnember Hendriksen noted that Bill's Superette agreed that they would give up the right <br />of access when the intersection of 153rd Avenue and T.H. #47 was signalized. <br /> <br />Public Works Committee/June 20, 2000 <br /> Page 4 of 7 <br /> <br /> <br />
