lot into two lots is recorded, the hotel site will have the access from Highway #10 and the aeeesg <br />from Riverdale. The restaurant site will have the access from Sunfish Lake Boulevard and the <br />access from Riverdale. At the time of final plat approval, it was anticipated that both lots would <br />want to share all public accesses, not just the one on Riverdale. Cross easements giving the hotel <br />site legal use of the Sunfish Lake Boulevard access and the restaurant site legal use of the <br />Highway #10 access would be required to facilitate this. Consequently, the development <br />agreement was drafted to require the Developer to provide the City with such easements in <br />recordable form. All obligations of the development agreement have been met with the <br />exception of providing the City with evidence that access easements between Lots 1 and 2 have <br />been drafted in recordable form. When these easements are provided, City staff can release the <br />plat for recording at the County. On January 6, 2000, City staff met with Michael McCollum, <br />attorney for the Grosslein's. Mr. McCollum indicates that in reviewing the situation more <br />closely, the Grosslein's are of the opinion that two-way traffic between the hotel Highway #10 <br />access and the restaurant Sunfish Lake Boulevard access could be a safety hazard and a complex <br />maintenance issue. Dana and Duke Grosslein are satisfied that the hotel is adequately served <br />with the Highway #10 and the Riverdale accesses, and that the restaurant is adequately served <br />with the Sunfish Lake Boulevard and Riverdale accesses. Staff is in agreement with the <br />Developers. During the meeting, it was also noted that right-of-access along Highway #10 <br />adjacent to Lot 1 is not dedicated to Mn/DOT on the final plat. To alleviate the City Engineer's <br />concerns that additional accesses onto Highway #10 might be sought in the future, the <br />Developers have taken action to make the necessary correction to the plat mylars. <br /> <br />Motion by Councilmember Connolly, seconded by Mayor Gamec, to amend the Development <br />Agreement for G~B Properties First Addition and eliminate Item #5 requiring access easements <br />between Lots 1 and 2 of the plat. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Connolly, Anderson, Hendriksen, <br />and Zimmerman. Voting No: None. <br /> <br />Case #4: <br /> <br />Enter Into Partnership Agreement with MnDOT for the T.H. #47 STP and <br />Associated Projects <br /> <br />City Engineer Jankowski presented the Council with an Agreement that acknowledges the State's <br />comlnitment to providing construction engineering and inspection on the T.H. #47 projects at no <br />cost to the City. This will save the City $256,000 over the previous cost estimate dated <br />November 30, 1999. The proposed Agreement would commit the City to paying the State 8% of <br />the construction cost on Sunwood Drive and C.S.A.H. #5 to cover inspection and contract <br />administration, and 4% of the construction cost to cover contract administration on the sewer and <br />water looping. The City will need to provide its own inspection of the sanitary sewer and water <br />looping. Mr. Jankowski noted the he received a call from MnDOT requesting an expedient effort <br />for change in work orders be added to the agreement and suggested that he be authorized by the <br />City Council to authorize change orders. <br /> <br />City Council/January 11, 2000 <br /> Page 9 of 17 <br /> <br /> <br />
