Voting No: None. <br /> <br />Case #3: <br /> <br />Request for a Conditional use Permit for Two Dwellings on One Parcel; Case <br />of Donald Kveton <br /> <br />Community Development Director Frolik stated that City Code stated that there shall not be <br />more than one main building on a lot unless otherwise provided for in City Code. Mr. Donald <br />Kveton is in the process of building his home at 5750 - 177th Avenue NW, Ramsey, and he is <br />requesting a conditional use permit to maintain a second dwelling on the property to provide <br />separate living quarters from his own for the caretakers of his hobby farm. The Planning <br />Commission conducted a public hearing on January 4, 2000. The neighboring property owner to <br />the west spoke in opposition to the request. One area of concern was that the hobby farm is <br />located at the terminus of a dead-end street with a cul-de-sac that appears to be inadequately <br />sized. The consensus of the Planning Commission was that 177th is appropriately marked as a <br />'dead end' street. The Commission forwarded the case to the City Council with a <br />recommendation of approval. On January 25, 2000, the City Council reviewed the case. During <br />the discussion, it was determined that the caretaker house is nearly constructed. Sometime in <br />October, the applicant was informed of the need for a conditional use permit to have two <br />dwellings on one lot. The applicant was instructed to submit an application for a conditional use <br />permit by November 16, 1999, in order to be placed on the December agendas of the Planning <br />Commission and City Council. Because of the time of year and impending cold weather, City <br />Staff entered into a hold harmless agreement with the applicant to allow the installation of frost <br />footings, at the risk of the applicant, prior to the issuance of a conditional use permit and building <br />permit. The one staff member left in the Community Development Department at that time took <br />an unexpected medical leave at the end of October. Consequently, there was no other <br />community development staff to follow up with Mr. Kveton to make sure the application was <br />filed and the hearing was scheduled. Upon staff's return from medical leave, it was noted that <br />the conditional use permit still had not been processed. Staff made the necessary contacts and <br />the matter was scheduled for a hearing at the Planning Commission meeting in January. The <br />Council tabled action on the case and requested additional information, which has been <br />presented. <br /> <br />Councilmember Hendriksen stated that as a Planning Commission member he recognized the <br />unique situation at Armstrong Kennels to construct a home for their own children on their <br />property and the unique situation of the Kurak property, but each time it seems that the standards <br />are being reduced. This request is the first to construct a second home for someone who will be <br />essentially renting since the home will be payment for labor. He understands that there is a <br />house already constructed and knows that it is not feasible that the home will be torn down.
