suggested drafting findings of fact and an agreement that will protect the City from having to build caretaker homes in the future. City Attorney Goodrich stated that the Council could reaffirm in the findings of fact that they do intend to enforce City Code allowing one home on one lot and the home was only constructed due to certain circumstances. Councilmember Zimmerman inquired if Council was satisfied with the turnaround concerns in the cul-de-sac. Community Development Director Frolik stated that the Planning Commission was satisfied since the road was identified as a dead-end. Director of Public Works/Fire Chief Kapler stated that he is familiar with the cul-de-sac and is comfortable with the situation. Mayor Gamec noted that he discussed the issue with the bus company and they stated that there was only one person entering onto the bus on the street so there currently has been no reason to drive down the road. If it was desired for the bus to drive down the road, they would be able to accommodate. City Attorney Goodrich recommend adding item #5a to the findings of fact stating: "That the City Council reaffirms the necessity of maintaining the City Code Section 9.11.01 providing that there shall be no more than one main building on a lot as said section as important City Planning and Zoning Regulations generally intended to benefit the health and welfare of the comments. That because of this finding the City generally opposes granting variances to this requirement (of City Code 9.11.0)." He also recommended adding item # 5b to the findings of fact stating: "That because of the unique circumstances by which the second home was built on the subject property, the Council deems it responsible to grant a Conditional Use Permit for the 2'~a home, however, the Council may reject any attempt to use this Conditional Use Permit approval as a precedent to avoid the requirements of section 9.11.01 in the future. Councihnember Hendriksen stated that the wording "will be" in item #8 of the findings of facts should be changed to "is", and item gl 0 should address the sale of the property requirements. Community Development Director Frolik stated that the issue is addressed in the CUP. If at any time the home is not being used for a caretaker then the property owner would be required to subdivide the property. Motion by Councilmember Connolly, seconded by Councilmember Hendriksen, to adopt Resolution #00-01-036 adopting Findings of Fact #0509, as amended, relating to Mr. Kveton's request for a conditional use permit for two dwellings on one parcel.
