Mike Berkopec, Ace Solid Waste, replied that before construction begins, they would make sure <br />everything is in line. If for some reason the City would chose not to approve the CUP for the <br />transfer station, they would have to reassess the project. <br /> <br />Mayor Gamec inquired if the Council were to give site plan approval for phase one, would they <br />be under any obligation for phase two. <br /> <br />City Attorney Goodrich replied that the Council could include wording that would exclude <br />agreeing to the CUP. <br /> <br />Councilmember Hendriksen suggested tabling the issue and consider the entire project. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to table the <br />issue. <br /> <br />Further discussion: Councilmember Connolly stated that she would like further information <br />from other cities that have similar facilities. Mayor Gamec inquired if Ace would he be willing <br />to bring some Councilmembers on a tour of similar facilities. Mr. Berkopec replied that he will <br />coordinate a tour. City Attorney Goodrich noted that the City has a 60-day requirement for <br />taking action on a request. Community Development Frolik replied that the City would have <br />until April 14t~ to make a decision or the Council could request a 60-day extension or the <br />applicant could waive the 60-day requirement. Mr. Berkopec stated that they would be willing to <br />waive the 60-day requirement. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #4: <br /> <br />Request to Amend Conditional Use Permit for Outdoor Recreational Uses <br />for Diamonds Sports Bar; Case of Diamonds Sports Bar & Grill, Inc. <br /> <br />Community Development Director Frolik stated that the City Council granted Diamonds Sports <br />Bar a Conditional Use Permit (CUP) on March 24, 1998. The site plan for the outdoor <br />recreational uses included softball, volleyball and broomball. The applicant requested that their <br />current CUP for outdoor recreational uses be amended to include batting cages, a splat ball <br />course, horse shoe pits, basketball, and roller hockey in the summer and boot hockey in the <br />winter. The City has made it a practice to require CUP's for outdoor recreational activities in the <br />commercial districts. The surrounding parcels to the east and south are part of the Mississippi <br />West Regional Park, the property to the west is zoned commercial, and the property is bounded <br />on the north by Highway #10. There is approximately 1,000 feet between the nearest point of the <br />subject property and the Mississippi River; however, the property is not included in the Critical <br />River Overlay District. There is approximately 1,100 feet between the nearest residential <br />neighborhood and the existing facility.
