Mr. Berkopee urged the Council to consider approval of their request and <br />offered to answer questions. <br /> <br />Councilmember Hendriksen asked if Condition #6 indicated their intended hours of operation. <br /> <br />Mr. Berkopec stated they prepared an operation plan prior to conditional use permit <br />consideration which has now been modified. He stated the transfer station will operate from 7:00 <br />a.m. to 5:00 p.m. Monday through Friday, and the truck terminal will have trucks leaving early. <br /> <br />Gary Hanson, President of Bake Star Company, stated they manufacture automated stainless <br />bakery equipment and his property is to the northeast of the subject site. He stated their concerns <br />were stated at the Planning Commission and the primary area he believed prevented this type of <br />facility was addressed in the City Planning Booklet which lists this area as being Grade 3, 4, and <br />5 wetlands. He presented a map of the site identifying those wetlands as being shallow and a <br />deep marsh. He asserted that State Ordinance and Rules clearly indicate that a transfer station <br />must not be located on wetlands. Mr. Hanson stated it has been indicated the drainage will flow <br />away from their site but when the fire hydrants were recently flushed, the flowage came from the <br />corner of the subject site, would over flow the pond, and negatively impact his property. He <br />presented colored pictures of the hydrant flushing activity and resulting water ponding. Mr. <br />Hanson stated it was indicated the flood would never reach an elevation of 867, however, this <br />ground is of a Beaker type, which is prone to flooding due to its drainage characteristics. He <br />stated the area of the site versus area of the ponds is about 15 to 1 and while they may meet the <br />minimal requirements for providing drainage to the ponds, as an adjacent lower elevation <br />neighbor, it raises his concern. He noted the Ace trucks will clearly be visible above the <br />proposed fencing which is also a concern. Mr. Hanson commented on the Planning Commission <br />resolution and findings of fact #11 through #20. He asserted the applicant's traffic will result in <br />an adverse impact and, while a well-mn facility may not adversely impact the surrounding area, <br />it is still a concern to him. He stated he believes the proposed use will change the essential <br />character of the area since it is an industrial area and is not an appropriate use adjacent to <br />industrial concerns. He noted this parcel is zoned Commercial Warehouse and the City's zoning <br />standards indicate it would be suitable for adjacent industrial, commercial, or retail use which is <br />not compatible with this type of use so a rezoning would also be needed. Mr. Hanson addressed <br />the mobile home community park that is adjacent to the facility and stated his concern about the <br />impact on those neighbors which may result in the need for additional notification to them. He <br />stated the Planning Commission felt the proposed use did not meet the intended character for the <br />area since the City wants to encourage the location of this type of facility more toward the <br />landfill site rather than virgin farmland such as this site. He noted the requirement for regular <br />cleaning of the trucks and asked how the facility would handle the wash water. He stated the <br />sanitary sewer system is designed as an 18 inch sewer system and would be inadequate for uses <br />other than an industrial type of application. He stated concern that this use would result in the <br />need to upgrade the sewer system and roadway which would result in additional costs to <br />neighboring property owners. Mr. Hanson pointed out a parcel of property which the City owns <br />due to tax forfeiture and asked if the City will grant easement across that ground to the applicant <br />and how assessments for the curb would be addressed. <br /> <br />City Council/April 25, 2000 <br /> Page 12 of 29 <br /> <br /> <br />
