dated September 27, 2005, revised October 19, 2005, and the Developer signing a Development
Permit with the City.

Motion carded. Voting Yes: Mayor Gamec, Councilmembers Cook, Olson, Elvig, Jeffrey,
Pearson and Strommen. Voting No: None.

Case #4:

Request for a Conditional Use Permit to Exceed the Maximum Allowable
Square Footage for Accessory Structures; Case of Troy Stenerson

Community Development Director Tmdgeon reported that the City has received a request for a
conditional use permit from Troy Stenerson of 9501 Inverness Lane NW, to construct an
accessory building that would exceed the maximum allowable square footage. Mr. Stenerson
resides in the Northfork development which has a condition in its covenants prohibiting outside
storage of equipment. He has a twenty-six foot long enclosed cargo trailer that is used to
transport his snowmobiles and ATV's and he currently stores the trailer on the driveway. Mr.
Stenerson has been notified by the Northfork Home Owners Association that the trailer must be
stored indoors if it is to remain on the property. The subject property is approximately 1.9 acres
in size and is eligible for 1,664 square feet of accessory building space. The proposed building is
30 feet by 40 feet (1,200 square feet) and the existing attached garage is 1,084 square feet. The
total square footing of accessory buildings would be 2,284, resulting in an overage of 620 square
feet. The exterior finish of the proposed building would match the finish and design of his home.
The building would not exceed 16 feet in height. Northfork's Architectural Review Committee
has approved the design plans. Mr. Trudgeon added that the proposed building will be located in
the northwest portion of the property, and conforms to all applicable setbacks. There is existing
vegetation between the neighbor to the north and the proposed building location that provides
some screening and the applicant has installed berms and evergreen trees to create additional
screening. The Planning Commission conducted a public hearing and no written or verbal
comments were received.

Motion by Councilmember Elvig and seconded by Councilmember Cook to adopt Resolution
#05-I 1-370 adopting Findings of Fact #0746 relating to Troy and Jennifer Stenerson's request
for a conditional use permit to exceed accessory building size requirements on the property at
9501 Inverness Lane NW.

Motion carded. Voting Yes: Mayor Gamec, Councilmembers Elvig, Cook, Jeffrey, Olson,
Pearson and Strommen. Voting No: None.

Motion by Councilmember Elvig and seconded by Councilmember Cook to adopt Resolution
#05-11-371 approving the issuance of a Conditional Use Permit to exceed accessory building
square footage restrictions at 9501 Inverness Lane NW based on the Findings of Fact and
declaring terms of same, contingent upon staff receiving the letter of approval from the
Northfork Homeowners Association.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Cook, Jeffrey, Olson,
Pearson and Strommen. Voting No: None.

City Council/November 7, 2005
