City Attorney Goodrich stated a work session is needed. <br /> <br />Mayor Gamec stated the amount should be paid subject to change. He noted if a reduction is <br />made he would be reimbursed that amount. <br /> <br />Motion by Councilmember Anderson and seconded by Councilmember Hendriksen to approve <br />site plan approval for Canvas Craft contingent upon compliance with the City Staff Review <br />Letter dated April 28, 2000. <br /> <br />Motion carded. Absent: None. <br /> <br />Case #6: Request for Site Plan Review for Transfer Station; Case of Ace Solid Waste <br /> <br />Community Development Director Frolik explained that the City Council reviewed and approved <br />the Conditional Use Permit request by Ace Solid Waste for the Transfer Station on April 25, <br />2000. They also reviewed and approved the site plan for the office/track terminal and requested <br />that the Planning Commission review the site plan for the transfer station portion of the site. The <br />Planning Commission reviewed the proposed Site Plan for the Transfer Station on May 2, 2000. <br />They recommend approval contingent upon compliance with City Staff Review Letter Dated <br />April 6, 2000, and subject to 1) positive outcome of the wetland determination and 2) <br />Confirmation that Ace Solid Waste will be the fee title owner of all that part of their property <br />adjacent to Azurite Street NW. Site Plans are not required to be subjected to public hearings. The <br />Planning Commission heard comments from Mr. Hanson, representing Bake Star, about their <br />concerns regarding landscaping along the common property line. The Planning Commission <br />directed City Staff to work with Mr. Hanson and Ace Solid Waste to try and develop a <br />reasonable screening plan on the common property line. City Staff, Ace Solid Waste, and a <br />representative from Bake Star met on Friday, May 19, 2000, to discuss intensifying the screening <br />along the common property line of Bake Star and Ace Solid Waste. There are nice native trees on <br />the site. Ace Solid Waste has agreed that a minimum of 24 trees would be transferred to another <br />area of the site. Bake Star has requested that the fence be located around the pond in the <br />northeast comer. Ace disagreed and the issue is unresolved. Community Development Director <br />Frolik asked if Ace Solid Waste has clear title confirmation of the wetlands. <br /> <br />City Engineer Jankowski stated after reviewing the information available, the GSG map does not <br />indicate it is a wetland and it is not on the national inventory's map. He added the GME <br />consultant stated on his survey in 1996, that there were no wetlands on the site. City Engineer <br />Jankowski stated the property is mostly tree covered. He noted the survey reported on the <br />environmental conditions on the site. He added he also reviewed the three-page report from <br />AllPhase Company Inc. which was prepared by John Kersin, a certified wetland delineator. City <br />Engineer Jankowski stated Mr. Kersin indicated his findings that it was not a wetland were based <br />on the soil not being consistent with a wetland. He noted Mr. Kersin mentioned burrowing <br />animals and vegetation not consistent with a wetland.
