City Attorney Goodrich stated in response to the gentleman who brought up the City Code <br />provisions. He noted the comment was made that the matter needs to be referred back to the <br />Planning Commission. He read from the applicable provision in the code. He added the Council <br />is not obligated to, but may refer the matter back to the Planning Commission. <br /> <br />City Engineer Jankowski stated it is a one to three slope. He noted that at the waterline the pond <br />is flat. <br /> <br />Councilmember Anderson asked if there is any factors which would address the safety issues. <br /> <br />City Engineer Jankowski stated the pond is relatively flat to walk out into. He noted at a three to <br />one slope, it can no longer be mowed with a riding lawnmower. <br /> <br />Councilmember Anderson asked about what may end up in the pond regarding the sanitary sewer <br />concerns. <br /> <br />City Engineer Jankowski stated one requirement is to obtain a permit from the Lower Rum River <br />Water Management Organization. He noted the Organization's engineer recommended approval. <br />He added there is an issue on where the truck wash water would go. City Engineer Jankowski <br />stated one condition was added to research whether the water would go into the sanitary sewer or <br />the storage treatment plant. <br /> <br />Councilmember Hendriksen asked about Ace's position. <br /> <br />Mr. Berkopec stated he does not know if one bay would be used for a truck wash. He noted there <br />might be a spot to wash trucks inside the facility. <br /> <br />Community Development Director Frolik stated it is her understanding that Anoka County felt it <br />is all right for this water to go into the city storm sewer. <br /> <br />Mr. Berkopec stated there is a difference between cosmetic cleaning and washing out the inside <br />of a truck. <br /> <br />City Engineer Jankowski stated the condition of the WMO was to research and resolve this issue. <br /> <br />Councilmember Hendriksen stated it is a "catch 22." He noted he had always thought one could <br />not run residue from the garage into the sanitary sewer. <br /> <br />City Engineer Jankowski stated a flume trap catches the oil before the water goes into the city <br />sewer. <br /> <br />Mayor Gamec stated it is the same filtering system a car wash has. <br /> <br />City Council/May 23, 2000 <br />Page 13 of 36 <br /> <br /> <br />
